CCR2009181-Dedication-Copper Oaks COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #181-2009 DEDICATION AND ACCEPTANCE OF PUBLIC IMPROVEMENTS IN AND FOR COPPER OAKS SUBDIVISION WHEREAS, Glen Miller, Donna Brady, and Diane Domurat, hereafter called “DEVELOPER” has constructed public improvements which include public street improvements, sanitary sewer, and storm sewer facilities on Copper Oaks Drive, Paige Court, and Copper Oaks Court in and for the Copper Oaks Subdivision; and WHEREAS, the DEVELOPER has completed the construction and installation of the following improvements: SANITARY SEWER 1,593 L.F. of 8” PVC at $48.00 per foot 12 manholes at $ 2,463.00 each 700 L.F. of 6” laterals at $35.00 per foot totaling 20 laterals STORM SEWER 2 manholes at $ 1,749.00 each 9 inlets at $ 1,409.00 each 140 L.F. 24” RCP) at $36.00 per foot 433 L.F. 15” RCP at $32.17 per foot 335 L.F. 12” RCP at $32.83 per foot 66 L.F. 28”x20” CMP at $83.00 per foot 1641 L.F. 6” PVC sump at $ 21.00 per foot 20 laterals ( 6 inch ) at $ 507.00 each 1 FES ( 24 inch ) at $750.00 each 3 FES ( 15 inch ) at $714.00 1 FES ( 12 inch) at $687.00 ROADWAY & TRAIL 1450 L.F. at $ 72.87 per linear foot of roadway measured along the centerline of the road 1100 L.F. at $ 13.63 per linear foot of recreational trail measured along the centerline of the trail 2850 L.F. at $10.12 per linear foot of curb and gutter and appurtenances (collectively called “IMPROVEMENTS”) in accordance with the provision of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called the “CITY”, and the City Engineer has certified the systems’ acceptability; and Reso. #181-2009 Page 2 WHEREAS, it is the Developer’s intent to, without charge to the CITY, unconditionally give, grant, convey and fully dedicate the IMPROVEMENTS to the CITY, free and clear of all encumbrances, and together with mains, conduits, pipes, plants, machinery, equipment and appurtenances which relate directly to the utilization of such IMPROVEMENTS; and WHEREAS, the DEVELOPER shall guarantee the public improvements to be dedicated against any defects due to faulty materials or workmanship which appear within a period of one (1) year from the date of dedication and shall pay for any damages resulting therefrom to the CITY property and shall indemnify the CITY against any claims, suits, or liabilities brought against the CITY at any time arising out of the alleged defects or other failure of this guarantee; and WHEREAS, the City Engineer has recommended a full release of the letter of credit for the Copper Oaks Subdivision given the Development Deposit does not have a negative balance which will bring the remaining amount to $0.00; and NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby accept dedication and acceptance of the public improvements within Copper Oaks Subdivision and authorize full release of the remaining letter of credit for said Subdivision. th DATED THIS 24 DAY of NOVEMBER , 2009 SPONSORED BY: FINANCE.
