RESOLUTION #091-2009
RESOLUTION APPROVING THE SALE OF REAL PROPERTY BY THE COMMUNITY
DEVELOPMENT AUTHORITY OF THE CITY OF MUSKEGO
WHEREAS, the Community Development Authority of the City of Muskego, Wisconsin
(the "Authority") is a body politic duly organized and existing pursuant to the provisions
of Section 66.1335, Wisconsin Statutes (the "Act");
WHEREAS, as a part of a program of blight elimination and community development
that the Authority is undertaking with respect to blighted property, the Authority deems it
to be necessary, desirable and in the best interest of the Authority to sell a parcel of
property more particularly described as Tax Key No. 2198.991.002 (Lot 1 on map
attached in Exhibit A) (the "Property") to K & V Property Management LLC (the
"Developer");
WHEREAS, pursuant to the Act, the Authority has submitted to this Common Council a
report on the sale of the Property which includes the terms, conditions and other
material provisions of the sale and is attached hereto as Exhibit B (the Report);
WHEREAS, the Common Council deems it to be necessary, desirable and in the best
interest of the City that the Property be sold to the Developer as described in the
Report.
NOW, THEREFORE, BE IT RESOLVED by the Common Council that the Report with
respect to the sale of the Property is approved.

REPORT TO THE COMMON COUNCIL
OF THE CITY OF MUSKEGO, WISCONSIN
IN CONNECTION WITH THE SALE OF PROPERTY BY THE
COMMUNITY DEVELOPMENT AUTHORITY OF THE CITY OF MUSKEGO
The Community Development Authority of the City of Muskego,
Wisconsin (the "Authority") proposes to sell to K & V
Property Management LLC (the "Developer") the property
described as Tax Key No. 2198.991.002 (Lot 1 on map attached in
Exhibit A) (the "Property"). The Authority acquired the
Property in \[2005\] and has been attempting to sell the
Property for development since that time. The Property is
to be developed pursuant to a development agreement between
the City of Muskego (the "City") and the Developer (the
"Agreement"). A draft of the proposed Agreement is
attached hereto as Exhibit B. The purpose of this Report
is to describe the terms, conditions and other material
provisions of the sale of the Property.
Terms and Conditions of the Sale:
The Developer is to pay the Authority $100,000
for the Property.
The Developer is required to use the Property in
accordance with the Authority's redevelopment
plan for the area. It is intended that an
automobile repair facility be constructed on the
Property.
The Developer cannot convey the Property without
the Authority's consent unless the Authority
first certifies that all building construction
and improvements to be constructed by the
Developer have been completed.
Other Material Provisions:
Pursuant to the Agreement, the City will agree to
provide the Developer with a grant in the amount
of \[$50,000\] upon substantial completion of the
building, as an incentive to undertake the
project.
