CCR2009027-Dedication-Woodland Creek COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #027-2009 DEDICATION AND ACCEPTANCE OF PUBLIC IMPROVEMENTS IN AND FOR WOODLAND CREEK ESTATES SUBDIVISION WHEREAS, Woodland Creek Estates LLC, hereafter called “DEVELOPER” has constructed public improvements which include public street improvements on Cardinal Drive, Cardinal Court, Acorn Drive, Creekside Drive and Creekside Court, the sanitary sewer lift station located on Outlot 3 (tax key number 2242-063), the sanitary sewer lines and water main lines installed within the right-of-way of Racine Avenue and all other sanitary sewer, water main and storm sewer facilities, including any and all equipment and appurtenances which may in any way be a part thereof or pertain to, in and for the Woodland Creek Estates Subdivision; and WHEREAS, the DEVELOPER has completed the construction and installation of the following improvements: Sanitary Sewer 896 LF at $ 143 /LF of 8” PVC SDR-18 Sanitary Sewer 3,380 LF at $ 59 /LF of 8” PVC SDR-35 Sanitary Sewer 1,961 LF at $ 40 /LF of 6” PVC Sanitary Laterals (60) 183 VF at $ 60 /LF of 6” Sanitary Risers (14 Each) 4,400 LF at $ 72 /LF of 6” PVC Forcemain 26 EACH at $ 2,900 /EACH Sanitary Manholes 1 EACH at $ 4,000 /EACH Sanitary Drop Manhole 1 EACH at $ 268,000 Lift Station with Portable Generator 1 EACH at $ 14,000 /EACH Junction Manhole for Forcemain and Connect to Existing Forcemain 1 EACH at $ 5,000 /EACH Connection to Existing Manhole and Sanitary Sewer Watermain 1,475 LF at $ 103 /LF of 16” watermain pipe 3,900 LF at $ 42 /LF of 8” watermain pipe 158 LF at $40 /LF of 6” Hydrant Leads 15 EACH at $ 1,900 /EACH of Hydrants 15 EACH at $ 700 /EACH of 6” valves 11 EACH at $ 900 /EACH of 8” valves 5 EACH at $ 1,800 /EACH of 16” valves 1 EACH at $ 400 /EACH of 2” Air Release 2 EACH at $ 400 /EACH of Anti–Seep Collar on 16” Watermain 60 EACH at $ 150 /EACH 1-1/4” Brass Sets 2,091 LF at $ 29 /LF 1-1/4” Water Service Storm Sewer 213 LF at $ 61 /LF of 30” Concrete Storm Sewer 1,194 LF at $ 44 /LF of 21” Concrete Storm Sewer Reso. #027-2009 Page 2 952 LF at $ 41 /LF of 18” Concrete Storm Sewer 1,011 LF at $ 36 /LF of 15” Concrete Storm Sewer 2,429 LF at $ 35 /LF of 12” Concrete Storm Sewer 62 EACH at $ 1,300 /EACH of Storm Manholes and Inlets 4 EACH at $ 3,600 /EACH of Pond Outfall Structures 1 EACH at $ 1,500 /EACH of 30” End Section 2 EACH at $ 1,300 /EACH of 21” End Section 3 EACH at $ 1,200 /EACH of 18” End Section 9 EACH at $ 1,000 /EACH of 12” End Section 440 LF at $ 19 /LF of 6” Storm Sump Line 1,495 LF at $ 22 /LF of 6” Storm Laterals (60) 3 EACH at $ 450 /EACH of Sump Cleanouts Paving 3,900 C/L LF of roadway including 8” of gravel base course, 30” Mountable and Vertical face curb and gutter, 4” of Asphaltic Concrete Binder Course at a lump sum of $ 239,667 750 C/L LF of Pedestrian Path including 6” of gravel base course, 2” of Asphaltic Concrete Pavement Course at a lump sum of $ 11,250 Note: Final Lift of 1 1/2” Asphaltic Concrete Pavement Surface Course has not been installed as of the date of this Dedication and appurtenances (collectively called “IMPROVEMENTS”) in accordance with the provision of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called the “CITY”, and the City Engineer has certified the systems’ acceptability except for the final lift of asphalt pavement; and WHEREAS, it is the Developer’s intent to, without charge to the CITY, unconditionally give, grant, convey and fully dedicate the IMPROVEMENTS to the CITY, free and clear of all encumbrances, and together with mains, conduits, pipes, plants, machinery, equipment and appurtenances which relate directly to the utilization of such IMPROVEMENTS; and WHEREAS, the DEVELOPER shall guarantee the public improvements to be dedicated against any defects due to faulty materials or workmanship which appear within a period of one (1) year from the date of dedication and shall pay for any damages resulting therefrom to the CITY property and shall indemnify the CITY against any claims, suits, or liabilities brought against the CITY at any time arising out of the alleged defects or other failure of this guarantee; and WHEREAS, the DEVELOPER must complete the installation of the final lift of asphalt, per the subdivider’s agreement, and such installation must meet all City requirements, and this improvement will be considered complete upon approval of the City Engineer; and Reso. #027-2009 Page 3 NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Finance Committee, does hereby accept dedication and acceptance of the public improvements in and for the Woodland Creek Estates Subdivision.
