RESOLUTION #102-2008
RESOLUTION TO RE-ESTABLISH DEDICATION FEES
WHEREAS, The Land Division Ordinance of the City of Muskego provide that various
fees may be established from time to time by Resolution of the Common Council; and
WHEREAS, The Finance Committee has recommended re-approval of the following
dedication fees due to recent enactment of 2007 Wisconsin Act 44 recreating said
dedication fees:
Single-Family Unit $1,941 per newly created unit or newly created lot
Multifamily Unit $1,445 per newly created unit or newly created lot
$580 per acre of developable land; and
WHEREAS, For the purpose of this resolution, the definition of non-developable land
for the per acre dedication fee shall constitute wetlands and/or
preservation/conservation easement areas; and
WHEREAS, If the parent parcel on a Certified Survey Map, with an existing dwelling
upon it, remains unchanged (meaning no construction or grading), the parent parcel
will not be assessed the per acre dedication fee until the time of further division; and
WHEREAS, The fees shall be assessed before the City will allow the final signoffs and
recording of a Certified Survey Map, Condominium Plat, or Final Plat; and
WHEREAS, The dedication fees, as per 2007 Wisconsin Act 44, may impose such a
dedication fee to fund the acquisition or initial improvement of land for public parks; and
WHEREAS, As per said State legislation, the “improvement of land for public parks”
means grading, landscaping, installation of utilities, construction of sidewalks,
installation of playground equipment, and construction or installation of restroom
facilities on land intended for public park purposes; and
WHEREAS, The City of Muskego Parks and Conservation Plan distinguishes land for
public park purposes as active (parks) and passive (conservation), thus, the Finance
Department shall disburse the dedication fees, upon payment, as follows:
-$1,881 per single-family unit or lot to a segregated account for active recreational parks
-$1,400 per multi-family unit or lot to a segregated account for active recreational parks
-$580 per acre of developable land to a segregated account for passive recreational parks
-$60 per single-family unit or lot to a segregated account for passive recreational parks
-$45 per multi-family unit or lot to a segregated account for passive recreational parks

WHEREAS, The Park Board and Conservation Commission will be the governing
bodies for determinations of dedication fee “in lieu of” situations, where a developer
may make land dedications in return for not having to pay certain fees.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby establish
the above fees subject to passage and publication of Ordinance #1276.
