PLEASE SEE ORDINANCES #1229-A, #1229-8, #1229-C AND #1229-D COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #1229 AN ORDINANCE TO AMEND THE 2010 COMPREHENSIVE PLAN OF THE CITY OF MUSKEGO THE COMMON COUNCil OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOllOWS: SECTION 1: The Common Council of the City of Muskego does hereby amend the 2010 Comprehensive Plan to reflect changes as depicted on the attached map. SECTION 2: A Public Hearing was held regarding the proposed amendments on May 9, 2006 in front of the Common Council. SECTION 3: The amendments to the existing 2010 Comprehensive Plan Map include two aspects: 1. To reduce the amount of land Use categories found on the current 2010 Comprehensive Plan Map, and; 2. To amend the 2010 land uses for specific properties. SECTION 4: The reduction in the land use categories are found on the attached map and consist of: 1. Combining the two Commercial land Use categories found in the current 2010 Comprehensive Plan Map into one Commercial land Use category, and 2. Combining the six Residential land Use categories found in the current 2010 Comprehensive Plan Map into four distinct Residential land Use categories. SECTION 5: The amendments to the 2010 land uses for specific properties are described as follows: All the area within Boundary #1 on the attached map that is currently shown as Medium Density Residential Land Uses within the current 2010 Comprehensive Land Use Map is amended to reflect Rural Density Residential Land Uses; All the area within Boundary #2 on the attached map that is currently shown as Medium Density Residential Land Uses within the current 2010 Comprehensive Land Use Map is amended to reflect Low Density Residential Land Uses; All the area within Boundary #3 on the attached map that is currently shown as Medium Density Residential Land Uses within the current 2010 Comprehensive Land Use Map is amended to reflect Rural Density Residential Land Uses; The area within Boundary #4 on the attached map that is currently shown as Medium Density Residential Land Uses, High Density Residential Land Uses, and Agricultural and Open Space Uses within the current 2010 Comprehensive Land Use Map is amended to reflect Medium Density Residential Land Uses, High Density Residential Land Uses, and Commercial Uses. SECTION 6: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect . . . Ordinance # 1229 the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. ( C-/)u. # /CZ::X 9 Planning Department MeRlo To: Council From: Jeff Muenk& Date: May 17, 2006 Re: Various 2010 Plan Mapping Changes FYI Planning Commission deferred their recommendation regarding the 2010 Plan amendments to: Hear more info from the Council and their constituents, and 2. To allow Alderman Buckmaster his input to Planning Commission as he was absent from the May 16, 2006 Planning commission meeting. Please openly discuss changes to the amendments you have in mind at the next Council meeting and staff can get that info back to Planning Commission for their decision. Deferral is recommended until Planning Commission can adopt a resolution. Any changes Council wishes to make to the 2010 Plan Map amendments ordinanæ should be stated and staff can rework the ordinance language and the attached map to reflect those approvals. Thank You.
