COMMON COUNCil - CITY OF MUSKEGO ORDINANCE #1176 AN ORDINANCE TO AMEND CHAPTER 9, SECTIONS 9.01(1)(b) and 9.02, OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Orderly Conduct) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 9, Section 9.01(1)(b), of the Municipal Code of the City of Muskego is hereby amended to read as follows: 9.01 DISCHARGE OF FIREARMS AND GUNS PROHIBITED. (1 ) GENERAL PROHIBITIONS AND EXCEPTIONS. (b) The firing or discharging of devices which propel a projectile by means of spring, air or gas pressure including but not limited to BB and pellet guns, and Airsoft guns, is permitted only upon private premises by persons who are over 14 years of age or are under direct personal supervision of a parent or guardian. SECTION 2: Chapter 9, Section 9.02, of the Municipal Code of the City of Muskego is hereby amended to read as follows: 9.02 THROWING OR SHOOTING OF ARROWS, STONES AND OTHER MISSilES PROHIBITIED. (1 ) No person shall throw or shoot any object, arrow, stone, snowball, or other missile or projectile, by hand or by any other means at any person or at, in or into any building, street, sidewalk, alley, highway, park, playground, or other public place within the City. (2) This section does not prohibit the throwing of snowballs, or use of paintball, Airsoft, or other such objects with the mutual consent of the parties involved in such activities, and with other conditions as may be required by ordinance. SECTION 3: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
