CITY OF MUSKEGO ORDINANCE #1169 - AN ORDINANCE TO AMEND CHAPTER 1, SECTION 1.10 (2) (d) and (f), CHAPTER 2, SECTION 2.09 (1) (b) (c) (d), CHAPTER 8, SECTION 8.05 (1) AND CHAPTER 12, SECTION 12.08 (6) (d) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Committees) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 1, Section 1.10 (2) (d) of the Municipal Code of the City of Muskego is hereby amended to read as follows: - (d) Shall oversee all building inspection and, code enforcement; maintain official records for building inspection; and whenever requested, shall make a report of all the doings of building inspection to the Public Works Committee or Common Council. SECTION 2: Chapter 1, Section 1.10 (2) (f) of the Municipal Code of the City of Muskego is hereby amended to read as follows: (f) Shall perform such other duties as from time to time may be prescribed by the Mayor, Council, Public Works or the Public Utilities Committees. - SECTION 3: Chapter 2, Section 2.09 (1) (b), of the Municipal Code of the City of Muskego is hereby amended to read as follows: (b) Public Works Committee (including streets, lighting, drainage, police, fire, building regulations, health, cable, refuse/recycling, etc.) SECTION 4:Chapter 2, Section 2.09 (1) (c) Public Services Committee is hereby deleted in its entirety. SECTION 5: Chapter 2, Section 2.09 (1) (d) shall be renumbered to 2.09 (1) (c). SECTION 6: Chapter 8, Section 8.05 (1) is hereby amended to read as follows: (1) To request the renaming of a City street, by anyone other than the City, a petition signed by at least fifty percent of all property owners along the street in question shall be submitted to the Public Works Committee for recommendation to the Common Council. Petition signatures shall be limited to one per parcel. Naming shall be accomplished through adoption of a formal resolution by the Common Council. - SECTION 7: Chapter 12, Section 12.08 (6) (d) is hereby amended to read as follows: (d) Enclosure of Junk or Salvage Yards. Every junk or salvage yard coming into existence after the 7th day of October, 1993, shall be enclosed by a solid fence to be approved by the Building Inspector and the Finance Committee of a height not less than 8 feet. Such fence shall be painted one color within 30 days after construction and shall be maintained in a proper condition of repair at all times. Junk placed in any junkyard shall be so piled as to not rest against or project through or over the enclosure. It shall be unlawful to affix or display or to permit to be affixed or displayed , ~;-)" Ordinance #1169 Page 2 ,- upon such enclosure any picture, sign, bill, placard, pamphlet, notice or other thing for the purpose of advertising or notification. Any junk or salvage yard in existence on the 7th day of October, 1993, shall not have to erect a fence required by this Section unless for reasons of public welfare and safety it is required by the Building Inspector and Finance Committee. SECTION 8: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
