ORD20031153'~ '~ I" COMMON COUNCIL- CITY OF MUSKEGO ORDINANCE #1153 AN ORDINANCE TO AMEND CHAPTER 17, OF THE MUNICIPAL CODE AND AMEND THE OFFICIAL ZONING MAPS OF THE CITY OF MUSKEGO (Conservancy Districts) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 17, Section 4.01(1) of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to rename the L-Low1and District to the C-1 Lowland Conservancy District, and create the C-2 Upland Conservancy District. SECTION 2: Chapter 17, Section 8.18 of the Municipal Code of the City of Muskego, Wisconsin is amended to rename the L-Low1and District to the C-1 Lowland Conservancy District. ' ' iMSKC2228998018! c., Ord. #1153 Page 2 :, SECTION 4: Chapter 17, Section 8.185 of the Municipal Code of the City of Muskego, Wisconsin is created to read as follows: 17:8.185 C-2 UPLAND CONSERVANCY DISTRICT STATEMENT OF INTENT The C-2 Upland Conservancy District is intended to prevent the destruction of valuable natural and man-made resources and, in particular, woodlands, wildlife habitat areas, perennial and intermittent stream corridors, remnant oak savannas and prairies, natural scientific areas, and areas of steep slopes. Regulation of these areas, including environmental corridors, should serve to control erosion and sedimentation, and to protect the natural resource base and promote and maintain the natural beauty of the area, as well as the health, safety, and welfare of City residents. The purpose of this District is also to specifically permit residential development within significant upland environmental areas identified in the City of Muskego Conservation Plan, and within isolated natural resource areas at densities consistent with the standards adopted by the Wisconsin Department of Natural Resources, the Metropolitan Milwaukee Sewerage District, and the City of Muskego. Said standards are identified in the Southeastern Wisconsin Regional Planning Commission Community Assistance Planning Report #64, Sanitarv Sewer Service Area for the Citv of Muskego, latest edition. Single Family detached dwellings on parcels less than 217,800 square feet existing at the time of adoption of this Section. 2. New Single Family detached dwellings on parcels equal or greater than 217,800 square feet. 3. Two Family Dwellings existing at the time of adoption of this Section. 4. Public, private, commercial & private non-commercial outdoor recreational facilities pursuant to Section 17:6.06 of this Code. Ord. # 1153 Page 3 '~ B. PERMITTED ACCESSORY USES 1. Private garages subject to the provisions of Section 17:5.02 of this Code. 2. One (1) private garden shed subject to the provisions of Section 17:5.02 of this Code. 3. Other accessory structures subject to the provisions of Section 17:5.02 and subject to approval of the Plan Commission and upon payment of fees and receipt of permits as required by the Common Council and amended from time to time. 4. Home occupations and professional offices subject to the provisions of Section l7:8.0l(7)B.5. of this Code. . 5. Private residential outdoor recreation facilities subject to the provisions of Section 17:6.06 of this Code. 6. Any other structure or use normally accessory to the principal uses permitted. 7. All those uses as listed in Chapter 12.03(3) pertaining to Peddlers, Canvassers, and Traveling Merchants shall be permitted without Plan Commission approval unless traffic congestion is a concern or the residential integrity of the subject and adjacent properties is compromised. 8. Vehicular storage space for not more than one vehicle may be rented to persons not resident on the lot, such space being defined as not more than 300 square feet, except that a maximum of two rental spaces may be permitted where they are the only spaces provided on said lot. C. PERMITTED USES BY CONDITIONAL GRANT 1. Rustic Structures as designated pursuant Section l7:6.03(3)E. of this Code. .~ SECTION 5: The several sections of this Ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other Ordinance whose terms are in conflict with the provisions ofthis Ordinance are hereby repealed as to those terms that conflict. SECTION 6: This ordinance shall be in full force and effect from and after its passage and publication. PASSED AND APPROVED THIS 14th DAY OF October ,2003.
