AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF MUSKEGO (The Settlement on Woods Road Subdivision) (A to RS-2/0PD) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOllOWS: SECTION 1: The following described property is hereby rezoned from A to RS-2/0PD: Being a part of the NE y.; of the NW y.; and the NW y.; of the NE y.; of Section 20, T5N R20E, City of Muskego, Waukesha County, Wisconsin being more particularly described as: Commencing at the northwest corner of said northeast quarter, thence S 88 18' 66" W along the north line of said northwest quarter 22.65 feet to the west line and its extension of an existing Certified Survey Map with no number, recorded as document no. 682388 in volume 3, pages 302-303; thence S 01 24' 53" E 20.089 feet to the north right-of-way line of Woods Road and to the place of beginning of this description. Thence continuing S 01 24' 53" E along the west line of said CSM, 480.00 feet to the west line of said CSM; thence N 01 24' 53" W along the east line of said CSM 544.50 feet to the north line of said northeast quarter; thence N 88 35' 07" E along the north line of said northeast quarter 894.144 feet; thence S 01 40'29" W 1,337.188 feet; thence N 88 18' 06" E 476.899 feet to the south right-of-way line of Woods Road; thence S 82 03' 50" E along said south right-of-way line 173.808 feet to the place of beginning. Containing 2,435,647 square feet, or 55.9148 acres of land. . SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 3: This ordinance is in full force and effect from and after passage, publication, and approval and execution of a final plat, a Subdivider's Agreement and letter of Credit for The Settlement on Woods Road Subdivision on or before September 6, 2003.
