~AN ORDINANCE TO AMEND THE ZONING MAP
'"OF THE CITY OF MUSKEGO
(Big Muskego Estates -R-2/RSE/SW to RS-2/0PD/SW)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO,WISCONSIN,DO ORDAIN AS FOLLOWS
SECTION 1:The following described property is hereby rezoned from R-2/RSE/SW to RS-2/0PD/SW:
A part of the Southeast one quarter and Southwest one quarter of Section 13,T5N R20 E,
City of Muskego,Waukesha County,Wisconsin,commencing at the northwest corner of
the southeast quarter of Section 13,and the beginning of the property to be described;
thence N87O 18'00"E 827.64 feet;thence S 01 011'16"E 1,789.28 feet;thence S 89001'
34"W 296.89 feet to a point on the centerline of Durham Drive;thence N 38045'12"W
444.48 feet along said centerline;thence S 360 03'13"37.85 feet to a found iron pipe;
thence S 360 03'13"W 439.64 feet;thence S 880 01'00"W approximately 2,854 feet to a
point on the shoreline of Big Muskego Lake;thence northerly along said shoreline
approximately 450 feet;thence N 870 34'56"E approximately 1,272 feet;thence N 890
46'36"E 30.79 feet;thence N 77 051'47"E 178.17 feet;thence N 07024'05"W 961.00
feet;thence N 03012'59"W 290.46 feet to a point on the south right-of-way line of Holz
Drive;thence N 87021'18"E 454.88 feet along said right-of-way line to a point on the
center line of Durham Drive;thence S 43 0 04'DO"E 59.28 feet along the centerline of
Durham Drive;thence N 460 56'00"E 83.68 feet;thence N 020 32'43"W 50.69 feet to a
point on the north line of the Southwest quarter of said Section 13;thence N 870 21'18"
E 799.39 feet to the northwest corner of the southeast quarter of Section 13 and the point
of beginning of this description.Said lands contains approximately 92.2137 acres.

SECTION 2:The several sections of this ordinance are declared to be severable.If any section or
portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid,unlawful,
or unenforceable,such decision shall apply only to the specific section or portion thereof directly specified
in the decision,and not affect the validity of all other provisions,sections,or portion thereof of the
ordinance which shall remain in full force and effect.Any other ordinances whose terms are in conflict
with the provisions of this ordinance are hereby repealed as to those terms that conflict.
SECTION 3:This ordinance is in full force and effect from and after passage and publication subject to
approval of preliminary plat and approval and execution of the predeveloper's agreement of Big Muskego
Estates,and further execution of the final developer's agreement and accompanying documents
acceptable to the City on or before March 1,2005 and approval of the final plat in substantial conformance
to the preliminary plat on or before March 1,2005.
