ORD20011071COMMON COUNCIL -CITY OF MUSKEGO ORDINANCE #I071 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF MUSKEGO (W180 S7677 Pioneer Drive - 8-3 to B-3/01P) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1. The following described property is hereby rezoned from 8-3 to B-3/01P. That part of the South X of Section 9. Township 5 North, Range 20 East, in the City of Muskego. described as follows: On the North by the South line of the lot formerly owned by Michael Lembezeder; on the East by the center line of the so called Waterford Road; on the South by the North line of the lot owned by Horn Brothers (which lot is heretofore known as the Creamery Lot); and on the West by the Creek passing through said Section. EXCEPTION AND RESERVING THEREFROM, that part conveyed to Frances F. Harris by Warranty Deed dated June 2,1947 and recorded on June 4,1947 in Volume 440 of Deeds at page 470, as Document No. 301736, and to Albert E. Czarnecki and Leona V his wife, by Warranty Deed dated April 11, 1949 and recorded on April 13, 1949 in Volume 490 of Deeds at page 438. as Document No. 324508. Waukesha County Records. ALSO EXCEPTING, that portion of land above described which lies beneath a frame shed and garage, brick store and dwelling as now situated and formerly owned by Louis A. Hengle and Beulah Hengle, his wife. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
