AN ORDINANCE TO AMEND THE ZONING MAP
OF THE CITY OF MUSKEGO TO TERMINATE CONDITIONAL USE PERMIT
(Parkside Inn Property, Tax Key No. 2192.998)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN
AS FOLLOWS:
SECTION 1. The Conditional Use Permit to allow the use of the following described
property as a tavern, zoned RS-2, is hereby terminated:
W191 S7690 Racine Avenue (Tax Key No. 2192.998)
SECTION 2: The several sections of this ordinance are declared to be severable. If
any section or portion thereof shall be declared by a decision of a court of competent
jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to
the specific section or portion thereof directly specified in the decision, and not affect
the validity of all other provisions, sections, or portion thereof of the ordinance which
shall remain in full force and effect. Any other ordinance whose terms are in conflict
with the provisions of this ordinance are hereby repealed as to those terms that conflict.
SECTION 3: This ordinance is in full force and effect from and after passage and
publication.

I sent out a questionnaire in regards to commercial property for the 2001 revaluation. Mrs.
Regina Giesegh stopped in the office and informed me that the bar has not been in operation for
two years. She signed the questionnaire stating that same information. I did direct Mrs. Giesegh
to the Sewer Utility Clerk in regards to questions she had on sewer use. I received an email from 0 A

the Sewer Utility Clerk in regards to a change in use. I did have a conversation
with the Mayor regarding if a premise did not operate within a period of time the conditional use
disappeared. I am asking for confirmation that this property has reverted back to RS-2 zoning so
I can into consideration that this removal of the conditional use may have an effect in regards to
value.
I did talk to the Deputy Clerk in regards to the liquor license. License for that premise was not
renewed after the June 30, 1999 expiration. I also asked Mrs. Giesegh if the property was
currently for sale. She stated it was not and that her son and his family lived in the upper
apartment but had to use the bar facilities on the first floor as that apartment has no kitchen.

Will you be changing property from commercial to residential? The property owner indicated the property had a
grandfather clause that if not used as tavern then would convert back to residential. I will need to know in order to charge
sewer usage. Thanks, Renee
