ORD20011057COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #IO57 AN ORDINANCE TO AMEND SECTIONS 12.02 (I), (2) and (3) OF CHAPTER 12 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO won-intoxicating and Soda Water Beverages) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1. Section 12.02 (l), (2) and (3) of Chapter 12 are hereby amended to read as follows: Section 12.02 NON-INTOXICATING AND SODA WATER BEVERAGES LICENSE REQUIRED. No person shall sell or offer for sale or traffic in non-intoxicating or soda water beverages unless licensed hereunder. A separate license shall be required for each premises where non-intoxicating or soda water beverages are sold or offered for sale. Application for a non-intoxicating or soda license shall be made at the Clerk-Treasurer’s office. The license may be issued by the Clerk-Treasurer. upon discretion of the Clerk, following application for said license. If the Clerk-Treasurer questions the issuance of the license, the matter will be forwarded to the Common Council for determination. DEFINITION. Soda water beverages are defined by 597.34, Wisconsin Statutes. Non- intoxicating beverages are defined by 566.0433(1), Wisconsin Statutes. LICENSES The fee for such soda water beverage license shall be per 566.0433, Wisconsin Statutes. The fee for such non-intoxicating beverage license shall be as determined from time to time by resolution of the Common Council, except when sold for consumption off premises, the license fee shall be per 566.0433. Licenses shall expire on June 30. POSTING OF LICENSE Every license issued hereunder shall be posted and kept in a conspicuous place on the premises where the non-intoxicating and soda water beverages are sold or offered for sale. ord. #I057 SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
