ORD19989580 0 COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #958 AN ORDINANCE TO AMEND CHAPTER 17, SECTION 5.02(2) D. AND SECTION 6.09(8)(b) TO CREATE SECTION 6.09(8)(b)(4) OF TEE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Signs) THE COMMON COUNCIL. OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 17, Section 5.02(2) D. is hereby amended to read as follows: D. The only structure permitted within such setback area shall be necessary highway and traffic signs, public utility lines and poles, walls and fences, as regulated by Section 4.05(2)D, rural mailboxes, signs as permitted under the individual district regulations or as permitted by Section 6.09(8)@)(4), structures other than buildings as regulated by Section 4.03, temporary structures as regulated by Section 4.05(3) and underground buildings as regulated in Section 4.04. SECTION 2. Chapter 17, Section 6.09(8)(b) is hereby amended to add the following: (8)(b) Directional Signs (4) A sign not exceeding two (2) square feet in total non-illuminated copy area (two sides of copy permitted), only for the display of local religious andor civic organization directional signage, may be permitted in the public right-of-way. Four (4) such signs per organization may be erected in the City at any intersection of an arterial and/or collector highway in any zoning district, but must be located within a two (2) mile radius of the subject organization. - Four (4) such signs per intersection shall be permitted. An individual organization may have one such sign per intersection. Such a sign shall not: be located so as to block the traveling public’s line of vision; impede safe traffic movements; interfere with the viewing and/or function of any trafiic control devices; be designed or positioned so as to be misconstrued as a trafiic control device. The sign sponsor(s) shall be responsible for all costs of maintenance and removal of the structure. For the purpose of this Ordinance, civic organization shall be defined as a public facility or property. SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
