ORD19979270 COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #927 AN ORDINANCE TO AMEND CHAPTER 17 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO TO CREATE SECTION 8.145 (8-5 Business Park District) WISCONSIN, DO ORDAIN AS FOLLOWS: THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, SECTION 1: Chapter 17 of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to create Section 8.145 to read as follows: 8.145 B-5 BUSINESS PARK DISTRICT A. Statement of Intent: This district is intended to provide space where diverse individual office, retail, and customer service uses may be mixed with light industrial. All these uses shall be required to adhere to high district wide standards of building architecture and grounds appearance, maintaining highly landscaped parcels free of outside storage or display. 0 0. Permitted Uses by Right: The following subject to approval by the Plan Commission of building, site and operational plans. (See Sec. 2.8). 1. Unless prohibited under (2) following, any use permitted by right, or by conditional grant (unless listed in D. below), in the B-1, B-2, B-3, B-4 and 1-1 basic use districts, and the 00s overlay use district. 2. a Prohibited Uses: Notwithstanding (1) preceding, and those of similar character, are prohibited or section C or D following, the following uses within this district: animal processing; caretaker or other residential uses; freight transfer stations or trucking terminals; mini-(self storage) warehousing; facilities where the manufacturing process involves smoke stack emissions; primary uses involving motor vehicle and trucks; uses with outside storage or display repair including but not limited to autos, boats such as but not limited to building and garden supply centers; and those uses (including restaurants, motels or motor fuel sales or vehicle service) which are significantly oriented to operations; extractive operations; outdoor animal trucking patronage; salvage or recycling kennels and runs; Irdinance #927 C. Permitted Accessory Uses: The following subject to approval by the Plan Commission of buildins. site, and operationai plans. (See Sec. 6.11). ~ 1. Any accessory uses as permitted by the basic or overlay use districts of B.(l) preceding, and uses if customarily associated with the including signs as permitted in the B-1 District, permitted use, but excluding those involving outside storage or display, or those involving an accessory building. D. Permitted Uses by Conditional Grant 1. The following uses may be permitted by way of Conditional Use Grant as approved by the Plan Commission: automobile sales with secondary service operations but not including the storage of junked or wrecked automobiles; public or private outdoor recreation facilities; outdoor theaters and music amphitheaters; radio, telephone and television, transmission tower. E. Building Design 1. Within this district, the Plan Commission, in approve building plans which do not treat all following Sec. 6.11 of this ordinance, shall not materials that present an equally finished facade exterior walls of all structures with acceptable to all sides. 2. 3. 4. Site Requlations 1. Lot Size = 40,000 sq. ft. min. 2. Minimum Lot Width = 150 ft. 3. Minimum Set Back = Arterial and Collector Streets - 75 ft. Local Street - 50 ft. 4. Minimum Offsets = (double for those side and rear areas adjacent to residential uses) Rear - 25 ft. Sides - 20 ft. 5. Floor Area Ratio = 50% 6. Landscaped = 20% 7. Height = Principle - 30 ft. (office 60 ft.) Accessary - 30 ft. be severable. If any section or portion thereof shall be declared SECTION 2: The several sections of this ordinance are declared to by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain conflict with the provisions of this ordinance are hereby repealed in full force and effect. Any other ordinance whose terms are in as to those terms that conflict.
