ORD1996899COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #E99 AN ORDINANCE TO AMEND CHAPTER 24, SECTIONS 24.03, 24.04 & 24.05 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Snowmobile Regulations) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 24, Section 24.03 of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: 24.03 DEFINITIONS For purposes of this ordinance, “accompanied“ is defined in Wisconsin Statutes 350.05 or 23.33 respectively: a) Snowmobile: accompanied means being on the same snowmobile as the operator; b) All-Terrain Vehicle: accompanied means being subject to continuous verbal direction or control. Shoulder: That portion of the highway within 10 feet of the qravel, pavement material, or arass not desianated or ordinarily roadway on which vehicles may park in an emergency, consisting of - - 0 ;sed for- vehicular travel Residential Access: See 350.01(10m). Highway: See 340.01(22). Roadway: See 340.01(54). Snowmobile Trail: See 350.01(17), including privately marked corridors designated for public use within the City of Muskego and frozen lake surfaces. SECTION 2: Chapter 24, Section 24.04 of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: 24.04 DESIGNATED HIGHWAYS (a) The operation of a snowmobile is permitted on State, County, and Federal Highways within the City pursuant to State Statute 350.02 except the following, where operation is not permitted: Janesville Road: East City limits west to Lincoln Drive. (CTH L) Racine Avenue: From Hillendale south to Richdorf Drive. (CTH Y) College Avenue: Entire length. Ord. #899 Page 2 i 0 (b) The operation of snowmobiles for residential access Only pursuant to 350.02(a)(6) is permitted on the shoulder or extreme right hand edge of the city-owned highways where the posted speed limit is greater than 25 MPH, except the following where operation is not permitted: Woods Road: Entire length. Pioneer Drive: Entire length. Lannon Drive: Entire length. Durham Drive: Woods Road north to Janesville Road. Tess Corners Drive: Entire length. (c) The operation of snowmobiles for residential access pursuant to 350.02(a)(6) is permitted only on the extreme right hand edge of the roadway on city-owned residential highways where the speed limit is 25 MPH or less except the following where operation is not permitted: All residential city-owned highways located north of Woods Road and east of W17200 (Lannon Drive) where the speed limit is 25 MPH or less. 0 City of Muskego, Wisconsin, is hereby amended to read as follows: SECTION 3: Chapter 24, Section 24.05 of the Municipal Code of the 24.05 MISCELLANEOUS RULES (a) Snowmobiles shall operate and travel in single file. (b) Snowmobiles when operating on city-owned highways pursuant to 24.04(b) or (c) shall operate with the flow of traffic. (c) The operation of snowmobiles on highways within the City is limited to December 1 through March 31.
