ORD1996891COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #091 AN ORDINANCE TO AMEND CHAPTER 20, SECTION 20.10 (3) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Display of Waterway Markers) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 20, Section 20.10 (3) of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: Display of Waterway Markers. No waterway marker shall be displayed, except in conformity with the requirements of the Department of Natural Resources. Muskego Lake to be marked with regulatory markers requiring slow, no-wake speed (Reference Wisconsin Administrative Code as per Section 2). The areas in Little shall be as from time to time established by Resolution of the Common Council. SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain conflict with the provisions of this ordinance are hereby repealed in full force and effect. Any other ordinance whose terms are in as to those terms that conflict. SECTION 3: This ordinance shall be in full force and effect from and after its passage and publication. Stats., please submit a signed copy of the ordinance upon passage. The Depment also approves the placement of 4 slow-no-wake waterway markers described in the enclosed application (numbered 2720). The authority for the placement of waterway markers is vested in the local authority, with the city being responsible for the placement, maintenance and upkeep of the markers. The city is responsible for ensuring the markers are placed as diagrammed in the application form. Please note the posting requirements outlined in NR 5.15, Wisconsin Administrative Code, which require a sign with a minimum of three inch lettering be posted at each public landing outlining all regulations more restrictive than state law.
