ORD1995880ORDINANCE #a80 AN ORDINANCE TO AMEND CHAPTER 10, SECTIONS 10.06(11) AND 10.07(3) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEG0 (Public Nuisances) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 10, Section 10.06(11) of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: (11) Obstructions of Streets and Excavations. (a) All obstructions of streets, alleys, sidewalks or crosswalks or bike paths, and all excavations in or under the same, except as permitted by the ordinances of the City or which, although made in accordance with such ordinances, are kept or maintained for an unreasonable or illegal length of time after the purpose thereof has been accomplished, or do not conform to the permit. (b) No person shall undertake any activity, resulting in the placement of mud, dirt, clay, alley, sidewalk, or bike path within the City, which creates sediment or other similar substance upon any street, gutter, alley, sidewalk, or bike path. a condition hazardous to others using the street, gutter, SECTION 2: Chapter 10, Section 10.07(3) of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: (3) Abatement After Notice. (a) If the inspecting officer determines that a public nuisance exists on public or private premises, but that the nature of such nuisance is public health, safety, peace, morals or decency, he may not such as to threaten great and immediate danger to the serve notice on the person causing or maintaining the nuisance to remove the same within ten (10) days. If such proper officer shall issue a citation to the person causing, nuisance is not removed within said ten (10) days, the permitting or maintaining the nuisance.
