ORD1995876COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #876 AND TO CREATE SECTION 30.14 (3.5) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Building Code) AN ORDINANCE TO AMEND CHAPTER 30, SECTION 30.00 WISCONSIN, DO ORDAIN AS FOLLOWS: THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, SECTION 1: Chapter 30, Section 30.00 of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: Section 30.00 - SCOPE The provision of THIS CODE shall govern the design, construction, alteration, repair, demolition, and moving of all buildings and structures within the CITY OF MUSKEGO, except that THIS CODE shall not apply to AGRICULTURAL BUILDINGS as defined by Chapter 30, Section 30.14 (3.5) other than farm residences. SECTION 2. Chapter 30, Section 30.14 (3.5) of the Municipal Code of the City of Muskego, Wisconsin is hereby created to read as follows: 0 AGRICULTURAL BUILDING - Agricultural Building means a building located on a parcel of 35 or more acres of contiguous land which s.91.01(1), Wis. Stats., which during the year preceding, produced is devoted primarily to agricultural use (as defined by gross farm profits, as defined in s.71.58(4), Wis. Stats., of not less than $6,000 or which, during the 3 years preceding, produced gross farm profits, as defined in s. 71.58(4), Wis. Stats., of not less than $18,000; or a parcel of 35 or more acres of which at least 35 acres are enrolled in the farmland preservation program.
