AND (3) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Zoning and Occupancy Permit) I L '0 I THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS : SECTION 1: Chapter 17, Sections 3.03 (l), (2), (2)A., (2)B., Wisconsin is hereby amended to read as follows: (2)C., (2)D. and (3) of the Municipal Code of the City of Muskego, 3.03 ZONING AND OCCUPANCY PERMIT (1) Required: No vacant land shall be occupied or used except for agricultural purposes, and no building shall be hereafter erected, Permit and Occupancy Permit have been issued certifying that any structurally altered, relocated, used or occupied until a Zoning such building, use, or occupancy complies with the provisions of this ordinance. Like permits shall be obtained before any change is made in the type of use, or before any legal non-conforming use is resumed, changed, extended, or granted conditional use status. (2) Procedure: A. Applications for a Zoning Permit shall be made to the time as the application to the Building Director or his Planning Director or his designee prior to or at the same designee for a Building Permit and Occupancy Permit, or prior to the commencement of any use not involving a Building Permit. B. A Zoning Permit Application shall be prepared and filed with the Planning Director for a Zoning Permit. For the purpose of defraying the cost of inspection and administrative processing of Zoning, Building and Occupancy Permits, such application shall be accompanied by a fee as established from time to time by resolution Ordinance (See Table - Chapter 17) for Zoning Permits and of the Common Council as provided in this Zoning in the Building Code of the City of Muskego (See Table #1 - Chapter 30) for Building and Occupancy Permits. (3) Expiration: If within 12 months of the date of application, no Occupancy Permit has been issued any Building Permit and Zoning and/or Planning Director shall make immediate investigation to Permit related thereto shall lapse and the Building Inspector proper authority. Upon showing of valid cause, the Building ascertain that no use or occupancy has in fact commenced without Inspector and/or Planning Director may grant an extension of such permit for a period not to exceed 6 months. SECTION 2: The several sections of this Ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this Ordinance are hereby repealed as to those terms that conflict. The location on the lot of any existing buildings, proposed additions, or proposed new buildings, including the measured distances between such buildings measured at both exterior wall and eave line and from the lot lines and from the center line of any abutting street to the nearest portion of such building. d. The proposed floor elevation of any proposed buildings in relation to the existing and/or established grade of any abutting streets.
