ORD1995856AMENDED COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #E56 AN ORDINANCE TO AMEND CHAPTER 17 TO CREATE SECTION 5.09 AND AMEND SECTION 6.04(4)G OF THE CITY OF MUSKEGO ZONING ORDINANCE (To Allow Certain Types of Manufactured Housing) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS : SECTION 1: Chapter 17, Section 5.09 of the Municipal Code of the City of Muskego, Wisconsin, is hereby created to read as follows: 5.09 BUILDING CONSTRUCTION construction shall conform to the standards as set forth in (1) One and Two Family Built-on-site Construction: all such Chapter 30 Building Code for the City of Muskego, Wisconsin Administrative Code Chapters ILHR 20, 21, 22, 23, 24, & 25 otherwise known as the Uniform Dwelling Code. Dwellings or Modular Housing as defined by ILHR 20.07,27 and WI (2) One and Two Family Built-off-site Manufactured Homes or State Statutes, Section 101.91: such structures shall be certified as such under 42 USC Sections 5401 to 5426, which, when placed or remodeled on site: A. Shall be set on an enclosed foundation in accordance with Wisconsin Administrative Code Chapters ILHR Uniform Chapter 30 Building Code for the City of Muskego, Dwelling Code Chapters 21 through 25 as applicable. The Building Inspector may require a plan to be certified by a registered architect or engineer to ensure proper support for the home. B. Shall be permanently installed on a foundation in accordance with manufactures instructions a copy of which shall be provided to Building Inspector at time of application. C. Shall be properly/permanently connected to utilities in accordance with all State and local regulations. D. Shall have a floor area equal to or greater than that required in the zoning district in which it is to be located. E. Shall have all chassis components removed prior to issuance of an occupancy permit. F. Shall be a minimum 25' in width and no less than two (2) sections. Chapter 30 Building Code for the City of Muskego, Chapter 32 Fire (3) Commercial Construction: such construction shall conform to Code for the City of Muskego, and Wisconsin Administrative Code Ordinance #856 Page 2 Chapters ILHR 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63, & 64. SECTION 2: Chapter 17, Section 6.04(4) G. of the Municipal Code of the City of Muskego, Wisconsin, is hereby amended to add the following to the end of the paragraph: (This section shall not apply to manufactured or modular one and two family dwelling units which are governed by Section 5.041 of this Zoning Ordinance): SECTION 3: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain conflict with the provisions of this ordinance are hereby repealed in full force and effect. Any other ordinance whose terms are in as to those terms that conflict. SECTION 4: This ordinance shall be in full force and effect from and after its passage and publication.
