ORD1993813AMENDED ORDINANCE #E13 COMMON COUNCIL - CITY OF MUSKEGO AN ORDINANCE TO AMEND CHAPTER 17, SECTIONS 3.06(2) B., 3.07 (3), 6.02(4) A., 6.07(3) A. AND 6.12 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Zoning Ordinance) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS : of the City of Muskego, Wisconsin, is hereby amended to read as SECTION 1: Chapter 17, Section 3.06(2) B. of the Municipal Code follows: ( 2 ) Procedure : B. Filing of Petition: A petition for change or amendment submitted by a private property owner shall be prepared and filed with the City Clerk and shall be accompanied by in triplicate on printed forms provided for the purpose a fee, as from time to time established by Resolution of the Common Council, to defray the cost of giving notice, investigation and other administrative processing. SECTION 2: Chapter 17, Section 3.07(3) of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to read as follows: (3) Petitions Not Involving Zoning Change: Where such hearing is required by the provisions of this ordinance as a result of a request for other than a zoning change or appearance before the Board of Appeals, such request shall be presented map or description clearly identifying the property involved to the City Clerk in writing, and shall be accompanied by a established by Resolution of the Common Council, to defray and by a fee payable to the City, as from time to time the cost of notification and holding of a public hearing. SECTION 3: Chapter 17, Section 6.02(4) A. of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to read as follows: ( 4 ) Procedure : A. (Am. #218) Petition: Petition may be made to the Common Council by the owner or agent of property proposed for such development, to amend the zoning map by the overlaying of an OPD District in order to permit the application of the provisions of this section to such development. Such petition shall be accompanied by a fee, as from time to time established by Resolution of the Common Council, and the following information: J Ordinance #813 Page 2 ,C' . ,:, SECTION 4: Chapter 17, Section 6.07(3) A. of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to read as follows: (3) A. A fee, as from time to time established by Resolution of the Common Council, to defray the cost of notification and holding of public hearing and administrative processing. Where the applicant is also requesting an accessory use in addition to a quarry permit, there shall be an additional fee, as from time to time established by Resolution of the Common Council. SECTION 5: Chapter 17, Section 6.12 of the Municipal Code of the City of Muskego, Wisconsin is hereby amended to read as follows: MINIMUM REVIEW FEES - PLAN COMMISSION A minimum review fee, as from time to time established by Resolution of the Common Council, shall be charged for all applications to the Plan Commission where a fee has not been otherwise established by the zoning ordinance. The review fee shall be applicable for, but not limited to the Permit Renewals, and Fireworks Stand Permits. Fees for following: Sign Approvals, Landscape Plan Reviews, Kennel other applications to the Plan Commission for, but not limited to Building Site and Operation Plan Review, Truck Parking Review, Second Garage Structure Requests, and Legal Lot Determinations shall be, as from time to time, established by Resolution of the Common Council. 0 SECTION 6: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 7: This ordinance shall be in full force and effect from and after its passage and publication.
