ORD1992732COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #732 AN ORDINANCE TO AMEND CHAPTER 7, SECTION 7.06 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO Weight Limitations THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 7, Section 7.06 of the Municipal Code of the City of Muskego, Wisconsin, is hereby repealed and recreated as follows: 7.06 WEIGHT LIMITATIONS. (I) Pursuant to Section 349.17(1), weight of 10,000 pounds or greater may not be operated on any Wisconsin Statutes, motor vehicles having a combined vehicle load street or alley in the City except: (a) On State Trunk Highways; (b) On County Trunk Highways; (c) If the vehicle is a motor bus; (d) If the street has been designated as a heavy traffic (e) When the operation of the vehicle is in conjunction with route a pickup or delivery, provided the gross weight of said A Highway weight limits, whichever is lower, and the vehicle does not exceed 16,500 pounds per axle, or Class or egress from a State Trunk Highway or County Trunk vehicle is operating on the most direct route of ingress Highway; (f) If the owner or operator of the motor vehicle has been granted a variance of the City of Muskego zoning regulations Section 17, permitting the parking of such vehicle, provided the vehicle is operating on the most direct route of ingress or egress from a State Trunk Highway or County Trunk Highway, and the gross vehicle weight does not exceed 16,500 pounds per axle, or Class A Highway weight limits, whichever is lower; (9) If the vehicle is an authorized emergency vehicle. (2) No motor vehicle may be operated on any street or alley within the City unless it is equipped with pneumatic tires. SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent decision shall apply only to the specific section or portion jurisdiction to be invalid, unlawful, or unenforceable, such thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect.
