ORD1991716COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #716 AN ORDINANCE TO AMEND CHAPTER 17, SECTION 6.04(4)G.2.c. OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO REGARDING OFF-STREET PARKING (Trucks, Trailers and Equipment) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS : Code of the City of Muskego, Wisconsin, is hereby amended to read as follows: SECTION 1: Chapter 17, Section 6.04(4)G.2.c. of the Municipal (c) The Plan Commission may also permit additional parking of trucks and equipment in any predominantly undeveloped areas, as defined as any area where there are no more than three (3) homes within a radius of 800 ft. of the proposed parking site, if, in their opinion, the request is of such a nature that it will not welfare of the residents of the City of Muskego. In making this affect the health, safety, morals, comfort, property and general decision, the Planning Commission consider any and all relevant factors including but not limited to development in the surrounding areas, effect on general attractiveness, screening, surrounding area, size of specific lot and general lots in be in writing and shall set forth the terms and conditions of and character of the surrounding area, etc. Said permit shall permit be in excess of three (3) years from the date of issue. the permit but under no circumstances shall the term of the Said permit may be renewed for a period if the Plan Commission is still of the opinion at that time that the above criteria is met. SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 3: This ordinance shall be in full force and effect from and after its passage and publication. PASSED AND APPROVED THIS 28TH DAY OF MAY , 1991.
