ORD1989637COMMON C0U:VCIL - CITY OF MUSKEGO 0,;IDINANCE #637 AN ORDINANCE TO AM:7ND CHAPTER 17, SECTIONS 3.06, 3.07, 3.08, 6.02, 6.07 h 6.12 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Fees) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WAUKESHA COUNTY, WISCONSIN, DO ORDAIN AS FOL,LOWS: zdnde SECTION 1: Chapter 17, Section 3.06(2)B. is repealed and d to read as follows: Filing of Petition: A petition for change or amendment submitted by a private property owner shall be prepared in triplicate on printed forms provided for the purpose and filed with the City Clerk and shall be accompanied by a fee of $100.00 to defray the cost of giving notice, investigation and other administrative processing. SECTION 2: Chapter 17, Section 3.07(3) is repealed and amended to read as follows: / d(3) Petitions Not Involving Zoning Change: Where such hearing is required by the provisions of this ordinance as a result of a request for other than a zoning change or appearance before City Clerk in writing, and shall be accompanied by a map or the Board of Appeals, such request shall be presented to the description clearly identifying the property involved and by a fee of $50.00 payable to the City, to defray the cost of notification and holding of a public hearing. SECTION 3: Chapter 17, Section 3.08(3)A. is repealed and amended to read as follows: id Filing: A notice of ap.?eal shall be filed with the officer or commission from whom the appeal is taken and with the Board of Appeals, speciEying the grounds thereof and accompanied by a fee of $35.00 to defray the cost of giving notice, investigation, ,and other administrative processing. The officer or commission from whom the appeal is taken shall forthwith transmit to the Board all the papers constituting the record upon which the action appealed from was taken. SECTION 4: Chapter 17, Section 6.02(4)A. is repealed and amended to read as follows: A. ECTION 6: Chapter 17, Section 6.12 is created to read as 4.12 MINIMUM REVIEW FEES - PLAN COMMISSION - A minimum review fee of Ten Dollars ($10.00) shall be charged for all applications to the Plan Commission where a fee has not been otherwise established by the zoning ordinance. The review fee shall he applicable for, but not limited to the following: Building, Site and Operation Plan Reviews, Sign Approvals, Second Garage Requests, Legal Lot Determinations, Truck Parking Permits, Landscape Plan Reviews, Kennel Permit Renewals, and Fireworks Stand Permits. SECTION 7: The several sections of this ordinance,are declared to be severable. If any section or portion th'ereof jurisdiction to be invalid, unlawful, or unenforceable; such shall be declared by a decision of a court of competent decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
