ORD1987573COMMON COUNCIL - CITY OF MUSKEGO - ORDINANCE 11573 (As Amended) AN ORDINANCE TO AMEND CHAPTER 17 SECTION 17:6.04 (4)G(2) and OF THE CITY OF MUSKEGO MUNICIPAL CODE SECTION .17:6/04 (4)G(3) Wisconsin, DO ORDAIN AS FOLLOWS: The Common Council of the City of Muskego, Waukesha County, 17:6.04 (4) follows: is hereby repealed and recreated to read as SECTION 1: Chapter 17 entitled Zoning Ordinance, Section G(2) 2. a. The parking of no more than one commercial pick-up truck with a gross weight of less than 10,000 pounds or commercial cargo van type truck with a gross weight of less than 10,000 pounds, shall be permitted in any district. For the purposes of this section, a commercial pick-up is defined as any open or enclosed cargo bed truck commonly referred to as a mini, 112, 314, or 1 ton pick-up with no more than 4 rubber road tires, which is licensed as a truck, and used to purposes. A commercial cargo van truck is defined as transport property or equipment for business any motor vehicle commonly referred to as mini-vans, cargo vans, commercial vans, or panel truck with no more than 4 rubber road tires, which is licensed as a truck and is used to transport property or equipment for business purposes. b. The parking of no more than one non-commercial pick-up truck with a gross weight of less than 10,000 pounds, for each permanent occupant of a property who possesses a valid Wisconsin driver's license shall be permitted. For purposes of this section, a non- commercial pick-up truck is an open cargo bed truck commonly referred to as a mini, 112, or 314 ton pick-up licensed as a truck and used for private transportation, transporting personal items or recreational use. c. The Plan Commission may also permit additional parking of trucks and equipment in any district if, in their opinion, the request is of such a nature that it will not affect the health, safety, morals, comfort, property and general welfare of the residents of the City of Muskego. In making this decision, the Planning Commission may consider any and all relevant factors including but not limited to: development in the Ordinance 573 (AsGAmeaded) Page 2 surrounding area, size of specific lot and general lots in surrounding area, effect on general attractiveness permit shall be in writing and shall set forth the and character of the surrounding area, etc. Said terms and conditions of the permit but under no of 3 years from the date of issue. A vehicle 35 feet or longer shall be classified as a mobile home. SECTION 3: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declard by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portions thereof of the ordinance which shall remain in full force and effect. Any other ordinances are hereby repealed as to those terms that conflict. SECTION 4: This ordinance shall take effect immediately upon passage and posting or publiccation as provided by law.
