ORD1985539-. n 8 STATE OF WISCONSIN: COUNTY OF WAUKESHA: CITY OF MUSKEG0 ORDINANCE NO. - 539 AN ORDINANCE TO REPEAL AND RECREATE THE "STATE CRIMINAL LAWS ADOPTED" SECTION OF THE CITY OF MUSKEGO MUNICIPAL CODE to update the State Criminal Laws Adopted Section of the City Code WHEREAS the City of Muskego Common Council recognizes there is a need dealing with the adoption of State laws prohibiting certain offenses: and WHEREAS the City of Muskego Common Council realizes that numerous changes have been made to the State Criminal Code since its original adoption: and City Code by updated: WHEREAS the City Attorney has recommended that this section of the County, State of Wisconsin, DO ORDAIN AS FOLLOWS: THEREFORE, the Common Council of the City of Muskego, Waukesha SECTION 1: Section 9.161.41(3) to 9.94 of the Municipal Code of the Citv of Muskego entitled "State Criminal Laws Adooted" is herebv repealed. Muskego entitled "State Criminal Laws Adopted" is hereby created to read as follows: SECTION 2: Section 9.001 of the Municipal Code of the City of 9.001 State Laws Prohibiting Certain Offenses Adopted. current and future statutory provisions of 161.41(3) and in Chapters 939 (1) Except as otherwise specifically provided in this Code, the to 947, Wisconsin Statutes, describing and defining regulation against the peace and good order of the State, and cross reference contained therein to other sections and subsections of the Wisconsin Statutes, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a Code as if fully set forth herein. Any act required to be performed or term of imprisonment, are adopted and by reference made ,a part of this prohibited by any current or future statute incorporated herein by reference is required or prohibited by this Code. Any future amendments, revisions or modifications of the current or future statutes incorporated herein are intended to be made part of this Code in order to secure uniform statewide regulation of peace and good order of the State. (2) In construing the foregoing Sections and all present and future Ordinances of the City of Muskego in which statutory provisions have been enacted by reference thereto, the construction of such Ordinances shall be made pursuant to Chapter 990 of the Wisconsin Statutes and any future amendments, revisions, modifications or recreation of the current of future Chapter 990 are intended to be made I J part of this Code in order to secure uniform statewide regulation of peace and good order of the State. FURTHER whenever the word "crime" is used in the foregoing Sections it shall be taken to mean "offense" and whenever the phrase "criminal intent" is used, it shall be taken to mean "intent". SECTION 3: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or portion thereof directly specified in the decision, and not affect the unenforceable such decision shall apply only to the specific section or validity of all other provisions, sections, or portions thereof of the ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict. SECTION 4: This ordinance shall take effect immediately upon passage and posting or publication as provided by law. Passed and adopted this &a day of @C.n?fize, 1985.
