AN ORDINANCE TO AMEND CHAPTER 1
SECTION 1 .02 OF THE MUNICIPAL CODE (POLICE POWERS)
ORDAIN AS FOLLOWS:
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO
amended to create the following sub-section:
SECTION 1: Chapter 1, Section 1.02 of the Municipal Code is
1.02(1) Every Aldermen shall have the powers of City Police
Officers, except the right to carry a gun.
SECTION 2: All ordinances or parts of ordinances inconsistent with or contravening this ordinance are hereby
repealed.
SECTION 3: This ordin.snce shall be in full force and
effect from and after its passage and publication.
PASSED AND APPROVED THSS 28th DAY OF August , 1984.

RE : VETO OF ORDINANCE #498 (As Amended) - POLICE POWERS
Dear Aldermen:
I have vetoed Ordinance #493 (As Amended) entitled, An Ordinance
to Amend Chapter 1, Section 1.02 of the Municipal Code (Police
Powers). After discussing it with several of you and after
that the need to have identification was the Council's intention,
listening to the discussion on the Council floor, it's my opinion
but instead Police Powers wm?re voted for. I agree the need for
identification is a valid rs?quest and should be supported by
every member of this Counci:L.
In a democracy there is a thin line between the proper use of
police protection and excessive police powers. Elected officials
can properly monitor police powers if they are legislators rather
than enforcers.
The outdated state law was created in the mid-19th century when
police forces were few or nonexistent. At that time there wasn't
as much concern with 1awsui:;s. Now a city can be held liable (at
the expense of the taxpayers) for the action or inaction of those
an emergency situation arises and an alderman with Police Powers
it authorizes to have a badge. Could a citizen sue the City when
choses not to react?
I have had considerable citizen input on this issue, and not a
single person felt there was a need for police protection to be
provided by an elected official.
Because your intent is for i.dentification purposes, I am
adopted. But, when everyone who is a member of this Council is
confident this Council would not abuse this ordinance as
no longer involved with politics, Ordinance #498 As Amended will
still be in the Municipal Cclde, giving Police Powers to all
future aldermen.
I respectfully request that you sustain my veto.
