Section 12.18 of the Municipal Code is hereby created to provide as follows: As per Attachment. SECTION 2. All ordinances o,r parts of ordinances inconsistent with or contravening this ordinance are hereby repea I ed. SECTION 3. Ill. i .% PURPOSE. The purpose of tllis subsection is to encourage the installation of emergency alarm systems in structures within the City of Muskego .in order to provide additional protection to persons and Iproperty from fire, crime (including burglary, robbery and vandalism), 'and such other hazards as may constitute a danger to persons or property. It is anticipated that suc17 instal lations will provide a method of early detection which will permit the fire and pol ice departments to i ncmase the present 'Ieve I of protect ion to persons and property. DEFINITIONS. A. "ARLARM SYST!ZM" as used in this subsection shall mean fire and/or burglar and/or other detection systems to be connected to the Muskego Police Department, as follows: B. FIRE OR SMOKE DETECTION SYSTEM: Any device designed to automatically detect tht? existence of a fire or smoke, and automatically sound an alarm. C. BURGLAR DETECT 101 SYSTEM: Any device designed to detect an unauthorized entry into a residence or place of business and automatically sound an alarm. D. EMERGENCY ALARM :5YSTEM: Any other device not included in above, designed to alert the police and fire departments of danger to persons or property. E. STRUCTURE: As used in this subsection shal I mean any building built for support, shelter or enclosure of persons or valuable property. APPLICATION REQUIREMENTS. A. PERMIT FEE. The installation of any alarm system shall require a City Electridal Permit. All electrical work done in connection with the ins,tallation of any alarm system shall be approved by the City.'s electrical inspector for final approval of the system. An application and inspection fee of $25.00 shall accompany the application. EMERGENCY ALARM SYSTEMS 12. I8 B. APPLICATION FOR PERMIT. Prior to the installation of any alarm system, a detailed plan and specification of the entire system shall be submitted for review and approval by the Chief of Pol ice. Such plan shal I show the location of all proposed devices. C. CODE REQUIREMEN-E. Any alarm s.ystem instal led in the City of Muskego shal I conform where appl icable to the City's electrical code, the minimum standards for such alarm systems as set forth by the National Fire Protection Association at the time of passage of this ordinance and are incorporated herein by reference. Such alarm systems shall also conform where ,applicable to the minimum speci.fications set forth in the building codes of the City of Muskego and all other applicable provisions of the Municipal Code of the City. No device or equipment not approved and tested by a recognized independent testing agency will be accepted. Variances from said location specifications may be permitted by the Chief of Police providing such variances are noted and accompany the application.for installation. D. INSPECTION REQUIRED. (I) Upon completion of installation, the system shall be tested by the installer to insure that said system operates in conformance to the specifications as approved. that t,he s specificat such tests (2) Subsequent tests may be required to insure ystems are still operational and still conform to ions. If such tests are required the results of shall be submitted to the Police Department. IV. REGULATION OF SYSTEM. A. CONNECTIONS TO THE POLICE DEPARTMENT. (I) Alarm svstems installed in commercial and residential buildinas may be connected to the Folic’e Department with the approval of the Chief of Pol ice. ., (2) The installation and maintenance thereof shall be at the expense of the property owner and the alarm company designated as the successful bidder to install the control panel at the Police Dispatch Center. Alarms which utilize radio transmiss ions to the alarm panel are also acceptable. Only alarms that have the capability of connection to a module will be allowed. Applications for connection to the Police Department shall provide for waiver and release of municipal liability by reason of such connection. B. FALSE ALARMS. 1:l) False alarms due to carelessness or other causes which are ;.eceived by the Police Department, requires a response by the Pol ice or Fire Departments resulting in unnecessary expense to the City and increases the risk of injury to responding personnel or damage to property (2) The term “false, alarm” as used in this ordinance shall mean a siqnal from an alarm system resulting in a response by the Police or Fire Department when an emergency situation does not exist. (3) The owner of any alarm system connected to the Police Department which actuates an excessive number of false alarms will, after notification by the Chief of Police, take the necessary steps to correct the situation. If the excessive false alarm condition is not corrected after the issuance of a written warning, the Chief of Police may at his discretion, order the alarm disconnected within 30 days from the police panel. Newly installed alarms shall not be subject to this provision for the first 30 days after connect ion to the department. C. The City Clerk shall give written notice of the time and place of the hearing of the appellant. (3) The owner (of any alarm system connected to the Police Department whi'zh actuates an excessive number of false alarms will, after notification by the Chief of Police, take the necessary steps to correct the situation. If the excessive false alarm con,jition is not corrected after the issuance of a written waming, the Chief of Police may at his discretion, order the alarm disconnected within 30 days from the police panel. Nl2wly installed alarms shall not be subject to this provision for the first 30 days after connect ion to the department. C. PENALTIES AND APPEALS. (I) Failure to comply with any provisions of this ordinance shall be cause for an alarm system to be discon,nected from the Police Department upon 30 days prior written,notice. (2) An order of disconnection issued by the Chief of Police as provided by this ordinance, may be appealed by filing a written notice of appeal with the City Clerk. Said appeal shall be filed within 10 days of the date of the order of disconnection. :3aid appeal shall be heard by the Common Council within 30 days of the date of filing the appeal.
