ORD1973250f- AMENDED ORDINANCE #250 AN ORDINANCE TO REZONE CERTAIN PROPERTY TO ALLOW PLANNED UNIT DEVELOPMENT AND TO AMEND THE ZONING MAP OF THE CITY OF MUSKEGO, WISCONSIN PREAMBLE WHEREAS, the common Council, upon recommendation of the Plan Commission, and after public hearings, has approved a general development plan for a subdivision to be known as "l-1us-Kee-Guac", pursuant to the provisions of Section 6.02, Chapter 17 of the Muni- cipal Code, and, WHEREAS, such plan provides for the development of (a) Forty four single family units north of McShane Road and around a lake, (b) Fifty single family units south of McShane Road, ~ (c) Two hundred thirty one patio homes )condominium units), which shall consist of 7010 two bedroom units and 3010 three bedroom units. NOW THEREFORE, THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: zoned as follows: Land presently zoned RS-3 in the Et of Section 12 to RS-2. The following described property is hereby re- Lands ïresently zoned 1-2 in Section 12, the NWt of Section 13, the NE4 of Section 14, and the Et of Section 11 to RS-2 with the exception of 31.9 acres of land on the north side of McShane Road owned by Mrs. Jean Wallner and Harold DeBack be rezoned to RSA with an OPD overlay. The approximately 84.9 acres on the south side of McShane Road owned by ~æs. Jean Wallner and Harold DeBack be re- zoned to RS-2 with an OPD overlay. r- SECTION 2.: Conditions. This ordinance is conditioned upon the development or the area in substantial compliance with the building site and operational plans heretofor approved by the Plan Commission and the Common Council and upon the owner and developer complying with the applicable requirements of Chapter 18, Section 6.02 of the Municipal Code which are incorporated into this ordiance by reference, and upon the owner and developer complying with the subdivision and platting laws insofar as they are applicable to the development. SECTION 3. Time of Commencement. This ordinance is further conditioned upon the approval of the final plat for the single family areas and of a final development plan with accompanying documents as required by Section 6.02 and the commencement of construction of roads and other facilities in the area within 12 months from the effective date of this ordinance. SECTION 4. Conditional Use Status. The zoning hereby approved ~1s in the nature of a conditional grant applicable solely to the pro- perty herein described and to the structures to be erected on the property and the uses described herein. The zoning map of the city as referred to in Chaper 17, Section 3.04 of the Municipal Code is hereby amended by reclassifying the property as shown on said map in accordance with Section 1 hereof. All ordinances or parts of ordinances incon- sistent with or contravening this ordinance are hereby repealed. SECTION 7.
