AN ORDINANCE REQUIRING THE LICENSING OF VEHICLES
USED IN THE TRANSPORTING AND DUMPING OF GARBAGE AND
REFUSE WITHIN THE CI TY OF MUSKEGO
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN,
DO ORDåIN AS FOLLOWS:
Section 1. Section 11.04 of the Municipal Code of the
City of Muskego is hereby created to read as follows:
11. 04 GARBAGE AND REFUSE.
(1) COLLECTION, TRANSPORTING AND DUMPING:
(a) Permit Required. No person shall for hire, engage
in the business of collecting, transporting and/or dumping of garbage,
rubbish or refuse, into or within the City of Muskego, until a permit
for each vehicle or truck used in such business shall have been first
obtained from the Common Council. Application for such permit shall
be made to the City Clerk, and the applicant shall pay to the City
Clerk at the time of filing such application a fee of $10.00 for
each vehicle or truck; except that if an applicant applies for
licenses for more than ten trucks, he may obtain a fleet permit
for an annual fee of $100.00 plus $3.00 for each additional truck.
(b) Application. An application for a permit hereunder
shall state among other things therein required, the type or kind
of garbage, rubbish or other refuse which the party intends to
haul or collect or dump.
(c) What Permit to State. Permits issued to commercial
haulers shall bear the license number of the truck and serial or
motor number thereof and the description of the truck. Such permit
shall at all times be carried in said truck when such truck is used
pursuant to the provisions of this section. The permit numbers,
three inches in height, shall also be painted on the doors on each
side of the vehicle or truck.

~ (d) Da8p1ng Restricted to Licenses Sites. No garbage,
rubbish or other refuse shall be disposed of or dumped upon any
lands irt the City, except upon lands which have been duly licensed
for that purpose by the City.
(e) Trucks tö be Covered. All garbage hauled upon
streets or highways within the City shall be in covered containers.
All other materials shall be so loaded as to prevent any loss
thereof while being transported.

(f) Revocation. The Common Council may at any time
after public hearing, cancel and revoke any permit issued here-
under, in the event of any violation thereof. The procedure for
hearing shall be pursuant to Section 11.03.
(g) Term of Permit. All permits issued hereunder shall
expire on June 30th of each year. The fee therefor shall be pro-
rated on a quarterly basis.
,_r- (h) All permits issued hereunder shall be kept in the
vehicle for which the permit is issued and shall be available for
inspection by any police officer or any other public official of
the City of Muskego upon demand.

(i) Penalty. Any person, firm or corporation
violating any provision of this ordinance shall be fined not
less than $10.00 nor more than $200.00 for each offense, and
a separate offense shall be deemed committed on each day
during or on which a violation occurs or continues.
Section 2. All ordinances or parts of ordinances
inconsistent with or contravening the provisions of this
ordinance are hereby repealed.
Section 3. This ordinance shall be in force and
take effect upon passage and pub1icatio
