AN ORDINANCE AMENDING CHAPTER 20
OF THE MUNICIPAL CODE
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN,
DO ORDAIN AS FOLLOWS:
SECTION 1. SECTIONS 20.01 THROUGH 20.10 OF THE MUNICIPAL 'W ODE ARE HEREBY REPEALED.
SECTION 2. SECTION.^ 20.01, 20.02, 20.03 AND 20.04 OF
THE MUNICIPAL CODE ARE HEREBY CREATED TO READ AS FOLLOWS:
20.01 STATE STATUT,fS ADOPTED. THE STATUTORY PROVISIONS
DESCRIBING AND DEFINING REGULATIONS WITH RESPECT TO WATER TRAFFIC,
BOATS, BOATING AND RELATED W.iTER ACTIVITIES IN THE FOLLOWING
ENUMERATED SECTIONS OF THE v.!rSCONSIN STATUTES OF 1969, EXCLUSIVE
OF ANY PROVISIONS THEREIN RE,LATING TO THE PENALTIES TO BE IPIPOSED
OR THE PUNISHPIENT FOR VIOLAT.!rONS OF SAID STATUTES, ARE HEREBY
ADOPTED AND BY REFERENCE HALE A PART OF THIS ORDINANCE AS IF FULLY

(2) No PERSON 0PERr.TING A MOTOR BOAT SHALL OPERATE SUCH
BOAT WITHIN 50 FEET OF ANY MOVING BOAT OF ANY TYPE, NOR WITHIN 100
FEET OF ANY STATIONARY WATER CRAFT OF ANY TYPE WHATSOEVER AT A SPEED
IN EXCESS OF 10 MILES PER HOUR.
(3) EXCEPT FOR INGIlESS AND EGRESS FOR DOCKING PURPOSES OR
(4) NO PERSON OPERATING A MOTOR BOAT SHALL OPERATE SUCH
BOAT WITHIN 100 FEET OF ANY SCUBA DIVING FLAG EXCEPT THE OPERATOR
OF THE BOAT ACCOHPANYING SCUi3A DIVERS OR THE OPERATOR OF AN EMERGENCY
PATROL OR RESCUE CRAFT.
20.03 ADDITIONAL J~EGULATIONS OF WATER SKIING.
(1 ) WHENEVER A BOA!P IS USED FOR TOWING PURPOSES, FOR
WATER SPORTS OR OTHERWISE, Ti3ERE SHALL BE NO LESS THAN 2 PERSONS IN
THE TOWING BOAT, ONE TO OPERATE THE BOAT AND ONE TO BE IN CHARGE OF
THE TOW LINE.
(2) WHEN PULLING A SKIER OR ANOTHER BOAT THE TOW ROPE
SHALL NOT EXCEED 75 FEET IN ,LENGTH.
20.04 EMERGENCY ASSISTANCE. WHEN THE OPERATOR OF A BOAT
OBSERVES THE DISPLAY ON A BO.ST OR BY A PERSON OF AN ORANGE FLAG
APPROXIMATELY 18 BY 30 INCHE.3, HE SHALL RENDER TO THE BOAT OR PERSON
DISPLAYING THE FLAG, SUCH AS,j.ISTANCE AS MAY BE NECESSARY TO SAVE THE
BOAT OR PERSONS, OR TO MININPITZE THE DAMAGES TO THEM, IN SO FAR AS IS
POSSIBLE TO DO SO WITHOUT SEAIOUS DANGER TO HIS OWN BOAT OR THE PER-
SONS ON BOARD. NO PERSON SHA.GL DISPLAY SUCH A FLAG UNLESS HE IS IN
NEED OF ASSISTANCE TO PREVENT BODILY INJURY OR DESTRUCTION OF PROPERTY.
SECTION 3. SECTI0,V 20.11 (20) OF THE MUNICIPAL CODE IS
HEREBY AMENDED TO PROVIDE AS FOLLOWS:
(D) A DESCRIPTION OF THE LIFE AND WARNING DEVICES TO BE
USED WHICH SHALL CONFORM TO THE RULES OF THE VISCONSIN CONSERVATION COMMISSION AND THE UNITED STATES COAST GUARD.
SECTION h. SECTION 20.15(3) OF THE MUNICIPAL CODE IS
HEREBY AMENDED TO READ AS FOALOWS:
(3) NO PERSON SHAL.', OPERATE A COMMERCIAL BEACH UNLESS THE
SWIHMING AREA rs DISTINCTLY ~LEARLY MARKED OFF BY BUOYS, AND IT IS
FURTHER REQUIRED THAT DURING THE HOURS THAT THE BEACH IS, USED BY
SWIMMERS, THERE SHALL BE A L,rFE GUARD ON DUTY WHO SHALL POSSESS A RED CROSS LIFE SAVING CERTIF,ZCATE OR ITS EQUIVALENT AND WHO SHALL BE
CAPABLE OF RENDERING IMMEDIATE ASSISTANCE TO PERSONS IN DISTRESS IN
THE WATER.
5. ALL ORD,~NANCES OR PARTS OF ORDINANCES INCON-
SISTENT WITH OR CONTRAVENING THE PROVISIONS OF THIS ORDINANCE ARE
HEREBY REPEALED.
