AN ORDINANCE TO REPEAL AND RECREATE
SECTION 9.22 AND El.23 OF THE MUNICIPAL CODE
OF THE CITY OF MUSKEG0 RELATING TO OPEN FIRES
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS
FOLLOFJS :
SECTION 1. Sections 9.22 and 9.23 of the Municipal Code of the City
of Muskego are hereby repealed. SECTION 2. Section 9.22 and Section 9.23 of the Municipal Code of the
Clty of Muskego are hereby rec1,eated to provide as follows:
9.22 OPEN FIRES RESTRICTED:
(1) REGULATIONS FOR OPEN FIRES: All bon-fires or other fires
shall be subject to the following regulations:
a) The perimeter of an area of a grass or brush fire must
be at least thirty (30) feet from any building, utility pole,
overhead wires or any other combustible material.
b) Wind direction ai: time of fire shall be away from
buildings and other combustible materials or structures, and
the wind velocity shall be not more than fifteen (15) miles

owner's property line, and burning shall be done at least
thirty (30) feet from any building, fence, structure or other
combustible material.
c) Burning shall be done only when wind velocity does not

Section 9.16 may also be held liable for the cost of replacing or
repairing such damaged or destroyed property in accordance with
Section 895.035, Wis. Stats.
(3) Any person who shall violate any provisions of this ordinance,
which by reason thereof shall require the services of the Fire
Department, shall upon conviction thereof pay a forfeiture of Two
Hundred ($200.00) Dollars together with the costs of prosecution,
and in default of payment of such forfeiture and costs are paid,
but not exceeding ninety (90) days.
SE:CTION 3. All ordinances or parts of ordinances inconsistent with or
contravening this ordinance are hereby repealed.
SECTION 4. This ordinance shall be in full force and effect from and
after its publication and passage.
