AN ORDINANCE CREATING THE OFFICE OF
AND MAINTENANCE OF THE MUNICIPAL COURT
FOR THE CITY OF MUSKEGO, WISCONSIN
MUNICIPAL JUSTICE AND PROVIDING FOR THE OPERATION
The Common Council of the City of Muskego, Wisconsin, do ordain
(ir as follows:
Section 1. Municipal Court for the City of Muskego, Wisconsin.
Pursuant to the authority granted by s. 254.01 and ch. 254, Wis.
Stats. (1967), as created by ch. 276, laws of 1967, there is hereby
established the municipal court for the City of Muskego, Wisconsin.
Section 2. Office of Municipal Justice Created. Pursuant
to the authority granted by s. 254.01, there is hereby created the
office of justice of the municipal court for the City of Muskego,
Wisconsin.
Section 3. Election; Term. The municipal justice shall be
elected at large at the spring election commencing with the April,
succeeding his election.

Section 4. Salary. The Municipal Justice of the Peace shall
receive a salary as determined from time to time by the Common
Council which shall be in lieu of fees and costs. No salary shall
be paid to the Justice for any time during his term for which he
has not executed and filed his official bond and oath as required
by sub. sec. (5).
Section 5. Bond; Oath. The municipal justice shall execute
and file with the clerk of :he circuit court for Waukesha County
the oath prescribed by s. 256.02 and a bond in the penal sum of
$500.00 as prescribed by Wisconsin Statutes.
Section 6. Jurisdiction. The municipal justice shall have
such jurisdiction as provided by law and s. 300.05 of the Wisconsin a statutes and exclusive jurisdiction of violations of city ordinances.
Section 7. Procedure. A. The municipal court for the City
of Muskego, Wisconsin, shal’l be open as determined by order of the
Municipal Justice.

B. The municipal justice shall keep his office and hold court
C. The procedure in municipal court for the City of Muskego
shall be as provided by this ordinance and state law including,
but not excluding because of enumeration, chs. 66, 254, 300, 301,
and 960 of the Wisconsin Statutes.
D. The municipal justice shall collect all fines and taxable
costs in any action or proceeding before him and shall pay over
such moneys to the City Treasurer not later than the 2nd business
day succeeding his receipt thereof. At such time the municipal
justice shall also pay over to the clerk all forfeitures collected
by him in actions for violation of municipal ordinances. The

municipal justice shall pay over to the county treasurer all fines
received by him prior to comnitment in criminal actions or proceed-
ings, in accordance with s. 960.30, Wis. Stats.
Section 8. Effective Date. This ordinance shall take effect 0 upon passage, publication and posting as provided by law, provided -
". that the incumbent municipal justice of the peace shall continue
to serve as the municipal justice of the municipal court for the
City of Muskego until the regular municipal justice is elected and

Section 9. All ordinances or parts of ordinances in conflict
herewith are hereby repealed and this ordinance shall take effect
from and after its passage and publication.
