ORD1965017THE HAYOR AND COMWON COUNCIL OF THE CITY OF HCTSKEGO, klRUKESHA, h/ISCONSI>T, 30 OXJAIN AS FOLLOWS: SECTION 1. CHAPTER iT OF SAID ORDINANCE IS HEREBY AMENDED TO READ AS FOLLOWS: CHAPTER IV DEPARTMENT OF BUILDIDG SUPERVISION SECTION 1. THERE IS HEREBY ESTABLISHED A DEPARTMENT WHICH SHALL BE KNOWN AS THE DEPARTMENT OF BUILDINGS, AND WHICH AS THE COMMON COUNCIL MAY FROM TIME TO TIME PROVIDE TO SHALL INCLUDE AN INSPECTOR OR INSPECTORS AND SUCH EMPLOYEES SUPERVISE THE CONSTRUCTION OF BUILDINGS AND PERMANENT EQUIPMENT OF BUILDINGS. SECTION 2. INSPECTOR, THERE IS HEREBY CREATED THE OFFICE OF BUILDING INSPECTOR. SUCH INSPECTOR SHALL BE APPOINTED BY THE MAYOR; SUBZECT TO CONFIRMATION BY THE CITY COUNCIL. :(A) SUCH INSPECTOR SHALL DEVOTE FULL TIME TO HIS DUTIES AND SHALL ACT UNTIL XIS SUCCESSOR SHALL BE DULY APPOINTED AND QUALIFIES. (E) To BE ELIGIBLE FOR APPOINTMENT, THE BUILDING INSPECTOR SHALL HAVE HAD AT LEAST FIVE (5) YEARS’ BUILDINQ EX- PERIENCE AS A LICENSED PROFESSIONAL ENGINEER OR ARCHITECT BUILDING INSPECTOR, CONTRACTOR OR SUPERINTENDENT OF BUILDING CONSTRUCTION’, FOR THREE YEARS OF WHICH EXPERIENCE HE SHALL HAVE BEEN IN RESPONSIBLE CHARGE OF WORK; AND HE SHALL BE GENERALLY INFORMED ON GOOD ENGINEERING PRACTICE IN RESPECT’TO THE DESIGN AND CONSTRUCTION OF BUILDINGS, THE BASIC PRINCIPLES OF FIRE PREVENTION, THE ACCEPTED REQUIREMENTS FOR MEANS OF EGRESS .AND THE INSTALLATION OF ELEVATORS AND OTHER SERVICE EQUIPMENT NECESSARY FOR XEALTH, SAFETY AND GENERAL WELFARE OF THE OCCUPANTS. (C) NO PERSON SHALL BE APPOINTED AS A TECHNICAL ASSISTANT UNLESS HE HAS HAD AT LEAST THREE (3) YEARS~- PRACTICAL EXPERIENCE IN THE TECHNICAL WORK WHICH HE IS APPOINTED TO SUPERVISE, OR IN RESPONSIBLE CHARGE OF BUILDING CONSTRUCTION, OR AS A SKILLED WORKER. SECTION 3. COMPENSATION. (A) SALARY OF WILDING INSPECTOR SHALL RANGE FROM .* $575.00 PER MONTRTO $675 00 PER MONTH. ANNUAL MERIT INCREASES OF UP TO $25.00 PER MONTH MAY RE GRANTED EACH SUBSEQUENT YEAR UNTIL THE MAXIMUM OF $673.00 HAS BEEN (B) THE BUILDING INSPECTOR SHALL BE AFFORDED PAID REACHED. VACATION TIME ON THE .FOLLOWING TERMS: (1) ONE WEEK AFTER ONE YEAR OF C0NTINUOU.S SERVICE; 2) TWO WEEKS AFTER FIFE YEARS OF CONTINUOUS S.ERVICE; AND 3) T€TR,EE WEEKS AFTER I.‘?., /’. TEN YEARS OF CONTINUOUS SERVICE. TIME SERVED WITH THE TOWN OF MUSKEGO WILL .BE CONSIDERED THE SAME AS SERVING WITH THE CITY OF MUSKZGO IF SUCH HAS BEEN CONTINUOUS. ANY VACATION TIME NOT TAKSN WILL BE FORFEITED. (c) THEJBCILDING INSPECTOR SHALL BE AFFORDED THE HOSPITAL AND MEDICAL PROGRAMS AS IS AFFORDED OTHER EMPLOYEES. THE CITY OF flUSKEG0-SHALL PAY THE RATE OF PREMIUM FOR A SINGLE )INDIVIDUAL, C‘R 50% OF THE RATE OF PREMIUM FOR A COMBINED SINGLE-FAMILY PLAN. SHALL FURNISH-AN ADEQUATE AUTOMOBILE FOR HIS OWN USE IN THIS POSITION, AND SHALL MAINTAIN SUCH AUTOYOBILE IN ALL’ RESPECTS AT HIS OWN EXPENSE. $50.00 PER MONXH FOR THE USE OF THIS AUTOMOBILE IN THE. CITY OF MUSKEGO SRALL REIMBURSE THE INSPECTOR’’ THIS POS*ON. INABILITY OF THE BUILLIING INSPECTOR TO ACT, THE CITY COUNCIL MAY APPOINT A DEPUTY BUILDING -INSPECTOR WHO SHALL HAVE THE SAME POWERS AS THE BUILDING INSPECTOR. SECTION 5. THE CITY COUNCIL MAY REMOVE SUCH BUILDING INSPECTOR OR- INSPECTORS OR-EMPLOYEES AT ANY TIME FOR ? MALE~NCE IN OFFICE, WPON DUE NOTICE AND HEARING. THE SECTION 4. DEPUTY. IN CASE OF THE ABSENCE OR THE INCOMPETENCE, INEFFICIENCY, NEGLECT OF DUTIES OR COUNCIL SHALL HAVE- THE: FURTHER RIGHT TO SUSPEND THE BUILDING INSPECTOR, PENDING A PROMPT HEARING, AND APPOINT A TEMPORARY BUILDING i-NSPECTOR TO ACT DURING THE PERIOD OF SUSPENSION. SECTION 6. ENFORCEMENT. HE SHALL HAVE EXCEPT WHERE OTHERWISE PROVIDED IN THIS ORDINANCE, THE GENERAL DEPARTMENT OF BUILDINCS, AND SHALL ENFORCE ALL STATE LAWS AND CITY ORDINANCES AND LAWFUL ORDERS RELATING TO THE MANAGEMENT AND CONTROL, OF ALL MATTERS PERTAINING TO THE CONSTRUCTION, ALTERATION, REPAIR, REMOVAL AND SAFETY OF BUILDINGS AND OTHER STRUCTURES AND -.PERMANENT BUILDING EQUIPMENT. THE BUILDING INSPECTOR SHALL HAVE THE AUTHORITY COMPLIANCE WITH THIS ORDINANCE, INCLUDING THE FILING OF .TO COMMENCE THE NECESSARY LEGAL -PROCEEDINGS TO ENFORCE COMPLAINTS AND THE SWEARING OUT OF WARRANTS. SECTION 7. POWER OF 1NSPECTOR. THE BUILDING INSPECTOR SHALL HAVE FULL POWER TO PASS UPON ANY QUESTION ARISING UNDER THE- PROVISIONS C’F THIS ORDINANCE RELATING TO BUILDINGS, SUBJECT TO CONDITIONS CONTAINED IN THIS ORDINANCE. SECTION 8. RECORDS AND REPORTS. THE BUILDING INSPECTOR SHALL KTEP A RECORD OF ALL APPLICATIONS FOR BUILDING PERMITS AND OCCUPANCE PERMITS IN A BOOK FOR SUCH PURPOSE AND REGULARLY NUMBER EACH PERMIT IN THE ORDER- OF ISSUANCE. HE SHALL KEEP A RECORD SHOWING THE NUMBER, DESCRIPTION AND SIZE OF ALL BUILDINGS ERECTED DURING HIS TERM OF OFFICE, INDICATING THE KIND OF MATERIALS USED AND THE COST OF EACH BUILDING, AND THE.AGGREGATE COST OF ALL BUILDINGS OF THE VARIOUS CLASSES. HE SHALL KEEP A RECORD OF ALL INSPECTIONS MADE, AND OF ALL REMOVAL AND CONDEHNATION OF BUILDINGS, AND A RECORD OF ALL FEES COLLECTED BY HIM. HE SHALL MAKE A MONTHLY REPORT TO THE CITY COUNCIL ON THE ABOVE MATTERS, AND REMIT ALL FEES COLLECTED BY HIM DURING THAT MONTH TO THE CITY TREASURER. SECTION 9. AUTHOIZITY OF INSPECTOR. THE INSPECTORS PROVIDED FOR IN TYfIS ORDINANCE SHALL HAVE THE POWER AND AUTHORITY AT ALL REASONABLE TIMES FOR ANY PROPER PURPOSE, TO ENTER UPON ANY PUBLIC OR PRIVATE PREMISES AND MAKE INSPECTION THEREOF AND TO REQUIRE THE PRODUCTION OF THE PERXIT FOR ANY BUILDING, ELECTRICAL OR PLUMBING WORK OR THE REQUIRED LICENSE THEREFOR. 10 PERSON SHALL INTERFERE WITH THE SAID INSPECTOR WHILE IN THE PERFORMANCE OF THE DUTIES PRESCRIBED IN THIS ORDINANCE,, SECTION 2, ALL ORDIMANCES INCONSISTENT WITH OR CONTRAVENING THE TERMS OF THIS ORDINAIJCE ARE HEREBY REPEALED.
