AN ORDINANCE TO AMEND THE ZONING MAP
OF THE CITY OF MUSKEGO
(Muskego Commerce Center East, LLC - BP-1 and BP-3 to B-3)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN
AS FOLLOWS:
SECTION 1: The following described property is hereby rezoned from BP-1 and BP-3
to B-3
Part of Lot 1 of Certified Survey Map No. 10605, being a part of the Northeast 1/4 and Southeast 1/4 of the
Northeast 1/4 of Section 3, Town 5 North, Range 20 East, in the City of Muskego, Waukesha County,
Wisconsin, bounded and described as follows; Commencing at the Northeast corner of said 1/4 section; thence
South 00°40’47” East along the East line of said 1/4 section 768.93 to the North line of Commerce Center
Parkway; thence South 88°49’02” West along said North line 547.00 feet to the point of beginning of the lands
to be described; thence continuing South 88°49’02” West along said North line 179.19 feet to a point; thence
Southwesterly 377.48 feet along said North line and the arc of a curve whose center lies to the Southeast,
whose radius is 260.00 feet and whose chord bears South 47°13’30” West 345.19 feet to a point; thence
Southwesterly 143.15 feet along said North line and the arc of a curve whose center lies to the Northwest,
whose radius is 135.00 feet and whose chord bears South 36°00’36” West 136.54 feet to a point; thence South
66°23’13” West along said North line 52.42 feet to a point on the East line of Moorland Road; thence Northerly
674.40 feet along said East line and the arc of a curve whose center lies to the East, whose radius is 1535.42
feet and whose chord bears North 09°32’16” West 668.99 feet to a point; thence North 20°45’13” East along
said East line 124.31 feet to a point; thence North 88°45’40” East along the North line of said Lot 1 a distance
of 125.00 feet to a point; thence North 80°43’42” East along said North line 50.57 feet to a point; thence North
00°40’47” West 291.36 feet to the South line of College Ave; thence North 88°45’40” East along said South line

Wisconsin, bounded and described as follows; Commencing at the Northeast corner of said 1/4 section; thence
South 00°40’47” East along the East line of said 1/4 section 768.93 to the North line of Commerce Center
Parkway; thence South 88°49’02” West along said North line 288.00 feet to the point of beginning of the lands
to be described; thence continuing South 88°49’02” West along said North line 259.00 feet to a point; thence
North 01°10’58” West 517.73 feet to a point in the North line of said Lot 1; thence North 71°05’23” East along
said North line and its Easterly extension 138.17 feet to a point; thence North 88°45’40” East along said
extension and North line 127.39 feet to a point; thence South 01°10’58” East 559.92 feet to the point of
beginning. Containing 142,227 square feet or 3.2651 acres;
SECTION 2: The several sections of this ordinance are declared to be severable. If
any section or portion thereof shall be declared by a decision of a court of competent
jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to
the specific section or portion thereof directly specified in the decision, and not affect the
validity of all other provisions, sections, or portion thereof of the ordinance which shall
remain in full force and effect. Any other ordinances whose terms are in conflict with the
provisions of this ordinance are hereby repealed as to those terms that conflict.

SECTION 3: This ordinance is in full force and effect from and after passage and
publication.
