ORD20091306-Chapter10 COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #1306 AN ORDINANCE TO AMEND CHAPTER 10, SECTION 10.05 (1), OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Signs) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 10, Section 10.05 (1), of the Municipal Code of the City of Muskego is hereby amended to read as follows: 10.05 PUBLIC NUISANCES AFFECTING PEACE AND SAFETY (1) Signs, Billboards, Etc. All signs and billboards, awnings and other similar structures over or near streets, sidewalks, public grounds or places frequented by the public, so situated or constructed as to endanger the public safety. (a) Political Sign: Notwithstanding any other provision of this ordinance, temporary political signs may be erected in any district without a permit provided they are not a danger to life or property, and are located on property with the permission of the property owner. No such sign shall be placed within the limits of any street, or highway, or on any City owned property. Highway limits include all the dedicated right-of-way, encompassing the traveling portion of the highway, the shoulders, the ditches, and adjacent dedicated areas. The prohibition hereunder extends to trees, utility poles, fence posts, stakes, and all other structures on which signs might be posted or placed except political signs installed or placed on motor vehicles. Any sign violating this section shall be summarily removed by the Board of Public Works authorized City personnel. All political signs, wherever located, must be removed within 10 days after the election for which they were erected. SECTION 2: The several sections of this Ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other Ordinance whose terms are in conflict with the provisions of this Ordinance is hereby repealed as to those terms that conflict. SECTION 3: This Ordinance shall be in full force and effect from and after its passage and publication. TH PASSED AND APPROVED THIS 24 DAY OF NOVEMBER , 2009.
