ORD20091305-Vehicles COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #1305 AN ORDINANCE TO AMEND CHAPTER 10, SECTION 10.05 (16) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Storage of Motor Vehicles) THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: - Chapter 10, Section 10.05 (16), of the Municipal Code of the City of Muskego is hereby amended to read as follows: 10.05 PUBLIC NUISANCES AFFECTING PEACE AND SAFETY (16) Storage of Motor Vehicles. Except as provided in Section 12.08(6)(a), no person shall store, park or leave unattended, any disassembled, inoperable, unlicensed, junked, wrecked or abandoned motor vehicle, except in an enclosure which houses such property from public view. For purposes of this section, a vehicle shall be considered operable if that vehicle is: (a) Titled and has a current registration from a state, district or territory of the United States and has a legal license plate(s) mounted on the vehicle; (b) Meets all requirements of Wisconsin Statutes, Chapter 347 and appropriate subchapters of Wisconsin Department of Transportation Trans 305; A Motor Vehicle in this subsection shall include, but not be limited to, an automobile, truck, motor home, bus, and trailer that can be licensed. This section does not apply to motor vehicles stored in connection with an automobile sales or repair business located in a properly zoned area. SECTION 2: The several sections of this Ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other Ordinance whose terms are in conflict with the provisions of this Ordinance is hereby repealed as to those terms that conflict.
