ORDINANCE #1296
AN ORDINANCE REPEAL AND RECREATE THE CHAPTER 18 LAND DIVISION
CODE OF THE CITY OF MUSKEGO
The Common Council of the City of Muskego, Waukesha County, Wisconsin, do ordain as follows:
SECTION 1: The Chapter 18 Land Division Code is hereby repealed and recreated and made a part of
the Municipal Code of the City of Muskego as adopted by Ordinance #1296.
SECTION 2: The City of Muskego is adopting a new 2020 Comprehensive Plan, which requires code
changes to the existing Chapter 18 Land Division Code section. The amendments are related to
mandating the use of Conservation Preservation land divisions in certain areas noted in the new 2020
Comprehensive Plan and some changes noted are in relation to the new naming of the Community
Development Department and associated job titles.
SECTION 3: The Chapter 18 Land Division Code changes are more specific to the following: Sections
18.03, 18.08, 18.10, 18.14, 18.20, 18.22, 18.25, 18.26, 18.30, 18.31, 18.32, 18.33, 18.34, 18.35, 18.40,
18.45, 18.50, 18.51, 18.52, 18.53, 18.54, 18.56, 18.59, 18.60, 18.70, 18.72, 18.73, 18.74, 18.75, 18.76,
18.80, 18.81,18.82, 18.90, 18.91, 18.92, 18.93, 18.94, 18.99, 18.100, 18.102, 18.103, 18.104, 18.105, &
18.106.
SECTION 4: That the code amendments are amended to make Conservation Preservation Subdivisions
voluntary instead of mandatory and amendments have changed to better promote and enhance the
City’s Conservation Subdivision ordinances in an effort to promote new developments conserving the
City’s open spaces and environmental corridors.
SECTION 5: A Public Hearing was held regarding the proposed amendments on March 10, 2009 in front
of the Common Council.
SECTION 6: A copy of said Ordinance has been on file in the Office of the Community Development
Department and open to public inspection for not less than two weeks prior to the date of this Ordinance
and said Ordinance is hereby incorporated into the Municipal Code of the City.
SECTION 7: The several sections of this ordinance are declared to be severable. If any section or
portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful,
or unenforceable, such decision shall apply only to the specific section or portion thereof directly
specified in the decision, and not affect the validity of all other provisions, sections or portion thereof of
the ordinance which shall remain in full force and effect. Any other ordinance whose terms conflict with
the provisions of this ordinance are hereby repealed as to those terms that conflict.
SECTION 8: This ordinance is in full force and effect from and after its passage and publication.
