ORD20071264Central Count COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #1264 AN ORDINANCE CREATING SECTIONS 1.9 (4) AND (5) OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO TO PROVIDE FOR THE CANVASSING OF ABSENTEE BALLOTS FOR ALL ELECTIONS IN THE CITY OF MUSKEGO BY THE MUNICIPAL BOARD OF ABSENTEE BALLOT CANVASSERS THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN AS FOLLOWS: Wisconsin State Statute 7.52 states, “the governing body of any municipality may provide by ordinance that in lieu of canvassing absentee ballots at polling places under State Statute 6.88, the municipal board of absentee ballot canvassers designated under § 7.53 (2m) shall canvass all absentee ballots at all elections held in the municipality.” SECTION 1: Chapter 1, Section 1.9 (4) and (5) are hereby created to read as follows: 1.9 ELECTIONS (4) CANVASSING OF ABSENTEE BALLOTS. The Common Council of the City of Muskego hereby provides for the canvassing of absentee ballots by the municipal board of absentee ballot canvassers designated under § 7.53 (2m) which shall canvass all absentee ballots at all elections held in the municipality pursuant to procedures established by the state division governing elections. (5) MUNICIPAL BOARD OF ABSENTEE BALLOT CANVASSERS The Municipal Board of Absentee Ballot Canvassers is hereby established as designated under § 7.53 (2m). The board of absentee ballot canvassers shall be composed of the clerk-treasurer, or a qualified elector of the municipality designated by the clerk-treasurer, and 2 other qualified electors of the municipality appointed by the clerk-treasurer. The members of the board of absentee ballot canvassers shall serve for 2-year terms commencing on January 1 of each odd-numbered year, except that any member who is appointed to fill a permanent vacancy shall serve for the unexpired term of the original appointee. SECTION 2: The several sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the ordinance which shall remain in full force and effect. Any other ordinances whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.
