BENEATH THE SURFACE OF EACH LOT TO SERVE IMPROVEMENTS THEREON, OR ON ADJACENT LOTS; ALSO THE
RIGHT TO TRIM OR CUT DOWN TREES, BRUSH AND ROOTS AS MAY BE REASONABLY REQUIRED INCIDENT TO THE
RIGHTS HEREIN GIVEN, AND THE RIGHT TO ENTER UPON THE SUBDIVIDED PROPERTY FOR ALL SUCH PURPOSES.
THE GRANTEES AGREE TO RESTORE OR CAUSE TO HAVE RESTORED, THE PROPERTY, AS NEARLY AS IS
REASONABLY POSSIBLE, TO THE CONDITION EXISTING PRIOR TO SUCH ENTRY BY THE GRANTEES OR THEIR
AGENTS. THIS RESTORATION, HOWEVER, DOES NOT APPLY TO THE INITIAL INSTALLATION OF SAID UNDERGROUND
AND/OR ABOVE GROUND ELECTRIC FACILITIES OR COMMUNICATION FACILITIES OR TO ANY TREES. BRUSH OR
ROOTS WHICH MAY BE REMOVED AT ANY TIME PURSUANT TO THE RIGHTS HEREIN GRANTED. BUILDINGS SHALL
NOT BE PLACED OVER GRANTEES' FACILITIES OR IN, UPON OR OVER THE PROPERTY WITHIN THE LINES MARKED
"UTILITY EASEMENT AREAS" WITHOUT THE PRIOR WRITTEN CONSENT OF GRANTEES. AFTER INSTALLATION OF ANY
SUCH FACILITIES, THE GRADE OF THE SUBDIVIDED PROPERTY SHALL NOT BE ALTERED BY MORE THAN FOUR
INCHES WITHOUT THE WRITTEN CONSENT OF GRANTEES.
THE GRANT OF EASEMENT SHALL BE BINDING UPON AND INURE TO THE BENEFIT OF THE HEIRS, SUCCESSORS
AND ASSIGNS OF ALL PARTIES HERETO.
NOTE:
THE DRAINAGE EASEMENTS SHALL BE MAINTAINED BY THE RESPECTIVE PARCEL OWNERS. THE PARCEL OWNERS
SHALL MAINTAIN SAID EASEMENTS IN AN UNOBSTRUCTED CONDITION SO AS TO MAINTAIN THEIR INTENDED
PURPOSE. CONSTRUCTION OF ANY BUILDING. GRADING OR FILLING-1N SAID EASEMENTS IS PROHIBITED. THE
PARCEL OWNERS GRANT TO THE CITY OF MUSKEGO THE RIGHT (BUT NOT THE RESPONSIBILITY) TO ENTER UPON
SAID EASEMENTS IN ORDER TO INSPECT, REPAIR OR RESTORE SAID EASEMENTS TO THEIR INTENDED PURPOSE.
EXPENSES INCURRED BY THE CITY FOR INSPECTION, REPAIR OR RESTORATION OF SAID EASEMENTS MAY BE
PLACED AGAINST THE TAX ROLL OF SAID PARCEL OWNER AND COLLECTED AS A SPECIAL CHARGE BY THE CITY.
PRESERVATION AREA RESTRICTIONS
1. THOSE AREAS OF LAND WHICH ARE INDICATED AS "PRESERVATION AREA' ON THIS
SUBDIVISION PLAT SHALL BE SUBJECT TO THE FOLLOWING RESTRICTIONS:
A. GRADING AND FILLING SHALL BE PROHIBITED UNLESS SPECIFICALLY AUTHORIZED BY THE
CITY OF MUSKEGO AND, IF APPLICABLE, THE WAUKESHA COUNTY PARKS AND PLANNING
COMMISSION, THE WISCONSIN DEPARTMENT OF NATURAL RESOURCES AND THE ARMY
CORPS OF ENGINEERS.
B. THE REMOVAL OF TOPSOIL OR OTHER EARTHEN MATERIALS SHALL BE PROHIBITED.
C. THE REMOVAL OR DESTRUCTION OF ANY VEGETATIVE COVER, LE., TREES, SHRUBS,
GRASSES, ETC., SHALL BE PROHIBITED WITH THE EXCEPTION OF THE REMOVAL OF EXOTIC
OR INVASIVE SPECIES, OR DEAD, DISEASED OR DYING VEGITAT)ON AT THE DISCRETION OF
LAND OWNER, FORESTER OR NATURALIST, AND WITH THE APPROVAL OF THE WAUKESHA
COUNTY DEPARMENT OF PARKS AND LAND USE.
D. GRAZING BY DOMESTICATED ANIMALS (HORSES, COWS, ETC.), SHALL BE PROHIBITED.
E. THE INTRODUCTION OF PLANT MATERIAL NOT INDIGENOUS TO THE EXISTING ENVIRONMENT
OF THE PRESERVATION AREA SHALL BE PROHIBITED.
F. PONDS MAY BE PERMITTED SUBJECT TO THE APPROVAL OF THE CITY OF MUSKEGO AND,
IF APPLICABLE, THE WAUKESHA COUNTY PARK AND PLANNING COMMISSION, THE
WISCONSIN DEPARTMENT OF NATURAL RESOURCES AND THE ARMY CORPS OF ENGINEERS.
G. CONSTRUCTION OF BUILDINGS IS PROHIBITED.
THE INTENT OF THE AFOREMENTIONED RESTRICTIONS IS TO SERVE AS A PERPETUAL
INSTRUMENT TO ATTAIN NATURAL PRESERVATION OF THIS AREA.
2. 30.0' PLANTING STRIP, THIS STRIP RESERVED FOR THE PLANTING OF TREES AND SHRUBS
AND THE BUILDING OF ALL STRUCTURES EXCEPTING PUBLIC OR PRIVATE UTILITY STRUCTURES
HEREON IS PROHIBITED.
3. ALL WETLAND AREAS SHOWN ARE TAKEN FROM C.S.M. NO. 9333
4- PER CITY OF MUSKEGO ORDINANCE 18.32 (3)(b)(7) THE CITY OF MUSKEGO 1S GRANTED
RIGHT OF ENTRY AND MAINTENANCE OF THE WATERMAIN, STORM SEWER & SANITARY
SEWER EASEMENTS. THE CITY IS RESPONSIBLE TO RETURN ANY SITE DISTURBANCES TO

RESTRICTIONS:

AND OPEN FENCES THROUGH WHICH THERE IS CLEAR VISION, NOR SHALL ANY PLANT
MATERIAL OR NATURAL GROWTH BE PERMITTED WHICH OBSCURES SAFE VISION OF THE
APPROACHES TO THE INTERSECTION.
3. PER SECTION 6.01(2) OF THE CITY OF MUSKEGO ZONING ORDINANCE, NO PRINCIPAL
BUILDING SHALL BE ERECTED SO THAT THE LOWEST FLOOR LEVEL IS LESS THAN 3 FEET
ABOVE THE HIGHEST ANTICIPATED SEASONAL GROUND WATER LEVEL,
4, ALTHOUGH ALL LOTS IN THE SUBDIVISION HAVE BEEN REVIEWED AND APPROVED FOR
DEVELOPMENT WITH SINGLE-FAMILY RESIDENTIAL USE IN ACCORDANCE WITH SECTION 236
WISCONSIN STATUTES, SOME LOTS CONTAIN SOIL CONDITIONS WHICH, DUE TO THE
POSSIBLE PRESENCE OF GROUNDWATER NEAR THE SURFACE, MAY REQUIRE ADDITIONAL
SOIL ENGINEERING AND FOUNDATION DESIGN WITH REGARD TO BASEMENT CONSTRUCTION.
IT IS RECOMMENDED THAT EITHER A LICENSED PROFESSIONAL ENGINEER OR OTHER SOILS
