Each individual lot owner shall have an undividable fractional ownership in Outlots 1 and 2 and the City of Muskego and Waukesha County shall not be liable for any fees or special assessments in the event they become the owner of any lot in the subdivision by reason of tax delinquency. The homeowners association is responsible for maintenance of the outlots and deed restrictions are on file at the County Register of Deeds. 2. WETLAND PRESERVATION RESTRICTIONS Those areas of land which are identified as a Wetland Preservation Area on sheets 1 and 2 of 3 on this Subdivision Plat shall be subject to the following restrictions: a. Grading and filling shall be prohibited unless specifically authorized by the City of Muskego and, if applicable, the Waukesha County Parks and Planning Commission, the Wisconsin Department of Natural Resources and the, Army Corp of Engineers. b. The removal of topsoil or other earthen materials shall be prohibited. c. The removal or destruction of any vegetative cover, i.e., trees, shrubs, grasses, etc., shall be prohibited, with the exception of the removal of dead, diseased or dying vegetation at the discretion of the landowner, forester or naturalist, and with approval of the Waukesha County Department of Parks and Land Use. d. Grazing by domesticated animals, i.e., horses, cows, etc., shall be prohibited. e. The introduction of plant material not indigenous to the existing environment of the Wetland Preservation Area shall be prohibited. f. Ponds may be permitted subject to the approval of the City of Muskego and, if applicable, the Waukesha County Park and Planning Commission, the Wisconsin Department of Natural Resources and the Army Corps of Engineers. g. Construction of buildings is prohibited. 3. ISOLATED NATURAL RESOURCE AREA PRESERVATION RESTRICTIONS Those areas of land which are identified as an Isolated Natural Area Preservation Area on sheets 1 and 2 of this Subdivision Plat shall be subject to the following restrictions: a. Grading and filling shall be prohibited except in connection with the construction of a sanitary sewerage disposal system, a residence in a designated pre -approved building envelope or with the specific approval of the Waukesha County Parks and Land Use. b. The removal of topsoil or other earthen materials shall be prohibited. c. The removal or destruction of any vegetative cover, i.e., trees, shrubs, grasses, etc., shall be prohibited, with the exception of the removal of dead, diseased or dying vegetation at the discretion of the landowner, or silvicultural thinning upon the recommendation of a forester or naturalist, and the approval of the Waukesha County Department of Parks and Land Use. The removal of any vegetative cover which is necessitated by the approved construction of residences, associated buildings and driveways, shall be permitted. d. Grazing by domesticated animals, i.e., horses, cows, etc., shall be discouraged to the greatest extent possible. e. The introduction of plant material not indigenous to the existing environment of the Isolated Natural Area shall be prohibited. f. Ponds may be permitted subject to the approval of the City of Muskego and, if applicable, the Waukesha County Park and Planning Commission, the Wisconsin Department of Natural Resources and the Army Corps of Engineers. g. Construction of buildings within the isolated Natural Area is prohibited, except as may be specifically provided for by a building envelope on the Subdivision Plat. Any alternations to such a pre -approved building envelope will require the approval of the Waukesha County Department of Parks and Land Use. 4. There shall be no direct vehicular access to Field Drive from Outlots 1 and 2. 5. BASEMENT RESTRICTION - GROUNDWATER Although all lots in the subdivision hove been reviewed and approved for development with single-family residential use in accordance with Section 236 Wisconsin Statutes, some lots contain sail conditions which, due to the possible presence of groundwater near the surface, may require additional soil engineering and foundation design with regard to basement construction. It is recommended that either a licensed professional engineer or other soils expert design a basement and foundation which will be suitable to withstand the various problems associated with saturated soil conditions on basement walls or floors or that special measures be taken. Soil conditions should be subject to each owners special investigation prior to construction and no specific representation is mode herein. 6. VISION CORNER EASEMENT The height of all plantings, berms, fences or other structures within the vision setback area is limited to 24 inches above the elevation of the center of the intersection. 7. A maximum of sixteen (16) domesticated livestock, generally construed to be one per salable parcel, and a single accessory structure for boarding purposes shall be allowed within Outlot 2. The stable shall conform to the following setbacks: 50 feet from all public right-of-ways; 50 feet from all plat boundaries; and 25 feet from all parcel boundaries. 8. The grantees agree to restore or cause to have restored the property, as nearly as is reasonably possible, to the condition existing prior to such entry by the grantees or their agents. This restoration, however, does not apply to the initial installation of the underground and/or above ground electric, signals, telecommunication, television and natural gas facilities, or to any trees, bushes, brush and roots which may be removed at any time pursuant to the rights herein granted. Buildings shall not be placed over grantees facilities and in, upon or over the property within the lines marked "Utility Easement Areas" without the prior written consent of grantees. After installation of any such facilities, the grade of the subdivided property shall not be altered by more than four inches without the written consent of grantees.
