Background Information:
The petitioner, Cornerstone Development, is applying to rezone a property located along Loomis Road –
STH 36 (Tax Key Nos. 2258.074, 2258.996.001 and 2259.970 and part of Tax Key Nos. 2261.978.003 and
2264.999). The project area is bounded by the entry driveway to Muskego Lakes Country Club to the west,
the Stonebridge Subdivision to the north and Loomis Road to the south. The request is to rezone from B-4 –
Highway Business District, RM-1 – Multiple Family Residence District and PD-38 – Stonebridge Planned
Development District to PD – Planned Development District based on RM-2 – Multiple Family Residence
District.
The site of this newly proposed rezoning and development is 43.37 acres in size. The proposal is for eighty
(80) units that would include all ranch style structures consisting of fourteen (14) two-family structures,
thirteen (13) four-family/double-duplex structures and a clubhouse with amenities for the residents of the
development. The development includes internal private roads that stem off of the entrance drive to
Muskego Lakes Golf Club, which will be improved to City standards and dedicated to the City as a public
street.
The proposed 80 multi-family units (in 27 buildings) results in approximately 1.84 units/acre or 1 unit per
23,631 square feet of land (gross). This density falls within the Medium Density Residential land use
category, which allow up to 2.99 units per acre, which is being requested as part of this proposal. The RM-2
zoning allows 10,000 square feet of land per unit and the proposal fits within that allowance. The applicant
is NOT requesting any type of density bonus as part of this request.
The open space required for the 80 proposed units is 560,000 square feet, or 12.86 acres. Based on the site
plan submitted there will be 30.80 acres of open space remaining after the site is fully built-out with all
residential dwellings and improvements. That equates to 16,770 square feet per dwelling unit, which is
within the 7,000 square feet per unit requirement. The Floor Area Ratio (FAR) for this proposed project is
10.8% (gross), which is within the allowed 30% maximum requirement.
The 2020 Comprehensive Plan currently identifies this area as Commercial use and High Density Residential
use and as part of this request the land use plan would be amended the entire area to Medium Density
Residential use.

Zoning
Currently this land is zoned High Density Residential and Commercial. It’s our understanding that this
zoning has been in place for some time; however, the commercial interest has not materialized.
We are requesting that this land be rezoned to a Medium Density Residential, RM-2 Planned
Development. This zoning is less intense than the High Density Residential and Commercial that is
currently in place. We believe our Planned Development Residential neighborhood is a great transition
between Loomis Road (STH 36) and the single-family residential neighborhood surrounding this
project.
Land Use Plan
The current Land Use for these parcels include B4, RM-1, PD-38. We are requesting a RM-2 Planned
Development to accommodate this residential neighborhood.
Environmental Features
The site is generally an agricultural field with pockets of wetlands. These wetland areas will be avoided
and will provide natural beauty for the neighborhood. In addition, there is a grove of trees along the
western edge of this site. We are avoiding those trees as well because they add a wonderful dimension
to this community.
Dwelling Units
The neighborhood will include 80 condo homes. Building elevations are illustrated on the following
pages along with floor plans. These buildings will match what we have done at the Glen of Pellmann
Farm and will have the required masonry ratio.
Density Evaluation
• Gross Density = 80 units / 43.4 acres = 1.84 units per acre
• Net Density = 80 units / 34.82 acres = 2.3 units per acre
• Gross Density = 43.4 acres / 80 units = 23,633 square feet per dwelling
• Net Density = 34.82 acres / 80 units = 18,959 square feet per dwelling

Operational Considerations
This is a residential condominium neighborhood that will be managed by a condo association. The
condo association will ensure all the landscaping is cared for, snow removal is done, and the club
house and amenities are cared for.
Club House
This community will have a club house that will be the focal point of activity. Architectural illustrations
of the club house are highlighted below:
Amenities
In addition to the club house, there will be several amenities surrounding the club house. They include
a swimming pool for owners and their guests. This community will also host a bocce court and
pickleball court.

This community will have exterior lamp post lighting that automatically turns on at dusk to help
illuminate the neighborhood. This lighting will have the right balance that provides light for safety but
isn’t too bright to be a problem.
Traffic Generation
Members of our project team met with the Wisconsin Department of Transportation (WDOT) on
January 14, 2020 to discuss this project. The response from the WDOT indicating some turn
movements and intersection upgrades to the existing intersection is outlined below:

Following up on our meeting yesterday regarding this development along WIS 36 in
the City of Muskego. WisDOT will require the installation of a southbound right-turn
lane on WIS 36 with a storage length of 350 feet and a taper of 150 feet. We will
not require any extension of the northbound left turn lane. The intersection will need
to be upgraded to meet the standards of a Type A2 rural high-speed intersection per
the WisDOT FDM. I have also attached the e-mail from Matt Mattrise at the DNR that
I gave you at the meeting.

Since this is a residential project, we don’t anticipate a heavy burden the City’s road network. Rather,
the traffic that is generated will be light as folks go to work, run errors, and shop at the local businesses.
Building Material
The exterior material used will include a durable hardiplank siding, stone, dimensional shingles, large
windows to encourage natural light within the homes, blush landscaping and foundation plantings.

CALL TO ORDER
Mayor Petfalski called the meeting to order at 6:44 p.m.
ROLL CALL
Present: Alderpersons Wolfe, Hammel, Terrence, Kapusta, Engelhardt, Kubacki, and
Madden. Also present: City Attorney Warchol, Public Works and Development Director
Kroeger, Planner Trzebiatowski, and Deputy Clerk Blenski.
STATEMENT OF PUBLIC NOTICE
The Deputy Clerk stated that the meeting was noticed in accordance with the open
meeting law.
COMMUNICATIONS FROM THE MAYOR’S OFFICE
There are several flooding issues throughout the City because of the amount of rain.
The Department of Public Works is diligently working to address all them. The Mayor
asked for everyone’s patience.
PUBLIC COMMENT
Michael Kuspa was present representing the Forest Glen Subdivision. The subdivision
does not oppose allowing additional multi-family units to the existing Basse Planned
Development (Will Rose Apartments).
Debra Bolton, W186 S7543 Kingston Drive, requested that the Common Council pull
Resolution #041-2020 out of Consent for discussion and an individual vote. The
Resolution relates to public comment during the Common Council meetings.
PUBLIC HEARINGS
The Deputy Clerk read the hearing notice to consider the petition of Reno Berg (of
PEGARL LLP) to rezone the vacant property described as Tax Key No. 2283.999.004
located on Crowbar Drive from A-1 - Agricultural District to RC-1 - Country Residence
District for the purpose of allowing a possible future land division on the property.
Planner Trzebiatowski stated this property was located just west of the Muskego Lakes
Estates Development. The size of the lot must be at least 88,898 in square feet to meet
the Comprehensive Plan. Mr. Trzebiatowski distributed and read a letter from the
developer, Mr. Reno Berg.

No one came forward to speak. Mayor Petfalski declared the hearing closed at 6:55
p.m.
The Deputy Clerk read the hearing notice to consider the petition of Justin Koeppler (AG
Architecture) on behalf of the Basse Family Trust to grant a zoning amendment to the
existing PD-42 Basse Planned Development District for the purpose of allowing
additional multi-family units and alterations to setbacks and/or offsets for property known
as Tax Key Numbers 2198.160.001, 2198.160.002, 2198.160.003 and 2198.160.004.
Planner Trzebiatowski stated that PD-42 originally allowed 90 units in two buildings, one
a 50-unit and one a 40-unit. The 50-unit building is currently under construction as
Phase I. In 2019, the Plan Commission allowed the number of units to be adjusted to 51
units (Building #1) and 39 units (Building #2) as a non-substantial change. Through
ongoing market research, the developer has determined that the number of one-
bedroom units is in higher demand. Therefore, the petitioner is requesting to change the
number of units in Building #2 from 39 to 45. This would increase the total number of
units to 96 and is considered a substantial change, which requires an amendment to the
PD-42 Zoning District. Additional parking spaces are required as a result of the increase
in living units. The petitioner is requesting a waiver to the setback requirement for
Building #2. If granted, Building #2 would have the same 30-foot setback from Janesville
Road as allowed for Building #1.
Mr. Trzebiatowski stated he received a phone call from Tim Kirchner, S66 W15060
Woodland Place, who stated the total unit count should not be increased. He also
distributed and read a letter from Scot Fridrick, President of the Lindale Villas Condo
Association. The condos are located immediately north of this development. The
correspondence from Mr. Fridrick indicated that there was no objection to the proposed
amendments.
Public Input:
Debra Bolton, W186 S7543 Kingston Drive. She stated she opposes the proposed
amendments because green space is being sacrificed. The Common Council should
consider what is the value to the City regarding the changes being requested.
Bill Carity was present and stated he represented the Basse Family. He is requesting a
minor reconfiguration for Building #2 to address the increased demand for one-bedroom
units. Mr. Carity noted that this project is unique; high-quality materials are being used.
There is a significant separation between the two buildings. A total of 8.15 acres will
remain open space, which represents 57% of the entire parcel. Building #2 may not be
constructed until 2021.
With no one else coming forward, the Mayor declared the hearing closed at 7:12 p.m.
CONSENT AGENDA
Alderperson Kapusta removed Resolution #041-2020 from Consent. Alderperson
Kubacki also removed Purchase of the Boom Truck from Consent. Alderperson
Kapusta moved to approve the remaining items under Consent Agenda.

NEW BUSINESS
Resolution #041-2020 – Resolution to Amend the Procedure Regarding Public Comment
During Common Council Meetings. Alderperson Kubacki moved to approve.
Alderperson Madden seconded. Mayor Petfalski stated an inconsistency was
discovered regarding the amount of time allowed under Public Comment. He is neutral
as to the amount of time the Common Council wants to allow. In all likelihood, he will not
enforce it. Several Alderpersons supported allowing residents the ability to speak and
request additional time if needed. Alderperson Kubacki is fine with a three-minute time
limit with the Chairperson of the meeting having the discretion to extend it. Alderperson
Terrance moved to amend to add, “subject to the discretion of the Chairperson of
the meeting” at the end of the fourth WHERAS. Alderperson Kubacki seconded;
motion carried. Resolution #041-2020, as amended, adopted.
Approve Acquisition Contract and Authorize Signatures for Budget Approved
Expenditures over $50,000.00 – Purchase of Boom Truck $192,836.00. Alderperson
Kubacki moved to approve. Alderperson Wolfe seconded; motion carried.

Planner Trzebiatowski noted that the Plan Commission already reviewed and made a
recommendation regarding the two Ordinances. Typically, the Plan Commission makes
its recommendation following receipt of the public hearing comments. He asked if there

Mrs. Kathy Hink, S91W13933 Boxhorn Drive registered to speak. She is a neighbor of
AJ’s Bar & Grill. There was no neighbor notification regarding the proposed August
events. She is concerned with the late time, noise, and garbage. Arrangements should
be made for offsite parking.

Updates from Aldermanic Liaisons:
Muskego Senior Taxi – Mayor Petfalski stated he and Alderperson Wolfe
would be meeting with representatives from the Muskego Senior Taxi Service
to discuss the City’s financial assistance.
Muskego Festival Committee – The Committee is talking about a scaled back,
one-day event on Saturday, August 29 with the parade on Sunday. There will
not be a carnival and the food court will be spread out.

WISCONSIN DEPARTMENT OF NATURAL RESOURCES
NR 208 - COMPLIANCE MAINTENANCE RESOLUTION
FOR 2019
WHEREAS, It is a requirement under a Wisconsin Pollutant Discharge Elimination
System (WPDES) permit issued by the Wisconsin Department of Natural Resources to
file a Compliance Maintenance Annual Report (CMAR) for the City of Muskego’s
wastewater collection system under Wisconsin Administrative Code NR 208; and
WHEREAS, It is necessary to acknowledge that the governing body has reviewed the
Compliance Maintenance Annual Report (CMAR) for 2019.
WHEREAS, The Muskego Sewer Utility had a 4.0 average in 2019.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego does hereby commit the necessary funding to operate the City’s sewer utility
efficiently and maintain its above 3.0 grade point average.

reduction to the Letter of Credit; and
WHEREAS, The Public Works and Development Director has recommended that the
Letter of Credit be reduced by $217,202.95, leaving a remaining balance of $62,970.00.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve

SECTION 2: The several sections of this ordinance are declared to be severable. If
any section or portion thereof shall be declared by a decision of a court of competent
jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to
the specific section or portion thereof directly specified in the decision, and not affect the
validity of all other provisions, sections, or portion thereof of the ordinance which shall
remain in full force and effect. Any other ordinances whose terms are in conflict with the
provisions of this ordinance are hereby repealed as to those terms that conflict.
SECTION 3: The Common Council does hereby amend the 2020 Comprehensive Plan
to reflect a change from Commercial use and High Density Residential use to Medium
Density Residential use.
SECTION 4: This ordinance is in full force and effect from and after passage and
publication subject to approval and recording of a Developer’s Agreement and approval
of a Building, Site and Operation Plan.
