PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. ROLL CALL Present: Alderperson Madden, Alderperson Borgman, Alderperson Engelhardt, Richard Rens, Police Chief and Scott Kroeger, Director of Public Works and Development Also Present: Randy Hojnacki, Ron Daliege, Mike Kuspa STATEMENT OF PUBLIC NOTICE The meeting was posted in accordance with open meeting laws. APPROVAL OF MINUTES Alderperson Borgman made a motion to approve the minutes of September 17, 2018, Alderperson Engelhardt seconded. Motion Passed 3 in favor. STATUS OF PROJECTS Discussion update. No formal action may be taken on any of the following: Moorland Road Reconstruction Director Kroeger stated the North end of the project is now open. Asphalt, pavement markings and final restoration are almost finished. Should be completed by September 20, 2018. Waukesha Water Director Kroeger stated plans for the return route should be available for review in the next two to three months. Bay Lane Reconstruction Director Kroeger stated the Public Information Meeting was held on September 10, 2018, and attended by 33 people. A meeting is scheduled with Bay Lane Elementary to discuss the project. The current plan is to move forward with construction in 2019. Hillendale Reconstruction Director Kroeger stated the Public Information Meeting will be September 27, 2018, from Page 1 of 3 Approval of Minutes of the September 17, 2018 Meeting Packet Page 3 4:30pm-6:30pm. Letters and plans were mailed out to residents. The information is also on our website. This construction is to take place in 2020. UNFINISHED BUSINESS Discussion update and possible action may be taken on any or all of the following: Request for Curve Warning Sign on Shady Lane and Forest Drive The Committee began discussing the very mature trees in the area. Alderperson Borgman did not approach the homeowner(s) about trimming or removing trees throughout the curve. The Committee decided to possibly exchange the current signage in the area instead of adding more signs. Director Kroeger will email the Committee a few options of yellow, hazardous curve signs to review before making the decision to purchase. The Committee deferred this final decision until the October meeting. Request for Crosswalk Pavement Markings at the Intersection of McShane Drive and Cheviot Road. It was determined that our DPW has not maintained the area in question for a number of years. It belongs to Tudor Oaks. Chief Rens presented speed study results. Mr. Hojnacki continued to try to persuade the Committee for pavement markings. The Committee has agreed to not move forward with pavement markings. Hillendale Speed Study Alderperson Engelhardt explained this was originally part of the Public Safety Committee before it was combined with Public Works. Mr. Daliege stated ongoing safety issues with speeders. Director Kroeger told the Committee this would be a good time to make a decision on changing the speed while the City is in the process of redesigning the road. Alderperson Engelhardt made a motion to lower the speed limit on Hillendale Drive (between Racine Avenue and College Avenue) to 30 mph. Alderperson Borgman seconded. Motion Passed 3 in favor. NEW BUSINESS Discussion update and possible action may be taken on any or all of the following: Kelsey Drive Parking Chief Rens stated the DNR opened up some additional hunting land in the area off Kelsey Drive. He has determined that people are parking throughout the curve, in turn causing unsafe driving conditions. He is recommending No Parking signs be placed on both sides of the road throughout the curve. A resident spoke agreeing with the no parking signs, plus also inquired if the DNR would be able to change its public access point to Muskego Dam Road. He also has a petition signed by the neighbors. Alderperson Borgman made a motion to approve the placement of No Parking signs throughout the Kelsey Drive curve on both sides of the road. Alderperson Engelhardt seconded. Motion Passed 3 in favor. Page 2 of 3 Approval of Minutes of the September 17, 2018 Meeting Packet Page 4 Forest Glen Subdivision Drainage Mike Kuspa, President of the Glen Forest Subdivision HOA, spoke on behalf of the homeowners. He gave background on the water issues happening in the subdivision. Mr. Kuspa believes the City signed off on a Master Grading Plan back in 2004 that was incorrect. Director Kroeger stated the subdivision opted to retain many large trees and little, to no landscaping was done near lots 18-21. The area was not built with storm sewers, but with swales and a retention pond to hold the water after it rains. This is happening correctly based on the original design. He continued that the neighboring farmer is not currently farming the land. This too, can affect water drainage and runoff. Director Kroeger said the City is not in the business of landscaping. He believes the homeowners and HOA should get together, take down some trees, regrade their lots and talk to the farmer as well, before the City would consider getting involved in this drainage issue. The Committee and residents continued to discuss the drainage issues and possible solutions at length. The Committee has deferred further discussions until the October meeting after all parties have gathered additional information. Water Main Assessments Director Kroeger explained to the Committee this is a possible policy change that needs to be addressed within the next year as the City prepares to reconstruct Bay Lane (1,000’ of pipe needs to be replaced). He briefly explained the City took over a number of subdivisions with private water systems. The City currently continues to repair on an as needed basis. Director Kroeger wants the Committee to decide, going forward, when it comes time to replace the water mains how it will be paid. Does the City assess the homeowners in full (not a viable option), assess them for a portion, raise the water rates or does the City take on the full burden of costs? Since the City does not require homeowners to hookup to water, unlike sanitary sewer, the City does not have funds built up to start paying for replacement water mains in private areas. Respectfully Submitted, Wendy Fredlund Transcribing Secretary Page 3 of 3 Approval of Minutes of the September 17, 2018 Meeting Packet Page 5 CITY OF MUSKEGO Staff Report to Public Works and Safety Committee To: Public Work and Safety Committee From: Scott Kroeger, PE, PLS, Public Works and Development Director Subject: Request for Curve Warning Sign on Shady Lane Drive/ Forest Drive Date: August 20, 2018 The City of Muskego Public Work and Safety Committee has received a request to install a “Curve” warning sign on Shady Lane Drive/Forest Drive. An aerial photo of the road has been inserted as a reference. Recommendation for Action by the Committee: From an engineering standpoint here are my findings: 1. Police have indicated that there has not been an accident in the last 10 years on this street. (information provided by City of Muskego Police) 2. The road has a speed limit of 25 mph. The street is located in a neighborhood and not designed to be a through street which means very little traffic is on the road. Page 1 of 2 Request for Curve Warning Sign on Shady Lane and... Packet Page 6 Additionally, there are “Slow Children” warning signs located at the curve in both directions to help reduce traffic speed. 3. According to MUTCD (Manual on Uniform Traffic Control Devices for Streets and Highways) Chapter 2C – Warning Signs. Section 2C.02 Warning Signs = “The use of warning signs should be kept to a minimum as the unnecessary use of warning signs tends to breed disrespect for all signs.” The committee should listen to all statements and make a decision on this manner. Packet Page 7 CITY OF MUSKEGO Staff Report to Public Works and Safety Committee To: Public Work and Safety Committee From: Scott Kroeger, PE, PLS, Public Works and Development Director Subject: Drainage Forest Glen Subdivision Date: September 17, 2018 The Forest Glen Subdivision HOA president, Aldermen Borgman, Dan Flamini and Scott Kroeger met on July 16, 2018 to discuss drainage concerns between lots 20 and 21 and behind lot 18. The Forest Glen Subdivision was built in 2004. In addition, Dan and Scott have visited the site several times to check out concerns and to follow up even before this meeting. I have attached a grading plan of the subdivision to indicate the area. I have also attached some storm water management report background as well. The ditch areas in question do fill up with water and do have standing water during storm events. The ditches are working well and convey the overland flow of water to the street. In all cases after a couple of days or a week depending on the storm event there is no standing water between lots 20 and 21. During our meeting we discussed the potential of removing trees behind lots 18, 19 and 21 and doing some grading work to help alleviate some drainage concerns. The initial design of the subdivision was to preserve these trees which allowed for very little grading work in this area. The HOA needs to give approval for any tree over 3 inches in diameter to be removed before a home owner can remove the tree. Recommendation for Action by the Committee: In order to alleviate some drainage concerns, the homeowners and HOA should start by working together and make improvements in grading their yards with the possibility of removing some trees as well. The committee should listen to all opinions and make a decision on this manner. The areas of concerns include Lake Lore (2000s), Lake Brittany (2000s), Guersey Meadows (1980s), and Kristin Downs (1990s) subdivisions. The City of Muskego did not charge a hook up fee or charge to put these homes in the WCA (Water Capacity Assessment). These systems are made out of ductile iron and have reached their life expectancy. These areas have consistently been the City of Muskego’s highest areas of water main repairs. The estimated cost to design and construct brand new watermains for these 4 areas is approximately $8.5 million. The watermain will not be replaced until they are in the area of the road program. The City of Muskego will continue to make repairs as needed. For the Baylane road project we have a small portion of watermain (approximately 1,000 feet) to be replaced. Since we are digging up Baylane road for this project this is the time to do this work. Therefore, the City of Muskego needs to put a policy in place on how to handle these costs so we are consistent moving forward. Recommendation for Action by the Committee: I am looking for a policy recommendation from the Committee. Page 1 of 1 Water Main Assessments - Defer to November Meeting Packet Page 13 CITY OF MUSKEGO Staff Report to Public Works and Safety Committee To: Public Work and Safety Committee From: Scott Kroeger, PE, PLS, Public Works and Development Director Subject: Heinrich Public Road Dedication Date: October 16, 2018 Mr. Heinrich plans to subdivide his property into 4 lots. As part of this subdivision, Mr. Heinrich will be dedicating public right of way for Heinrich Drive which will serve these 4 lots. Currently, the road is already paved to the existing house where a turn around/cul de sac is provided for the general public. For lot 1, an existing gravel drive connects to the existing turn around which provides access to an existing structure located in lot 1. Mr. Heinrich is requesting to keep this gravel driveway as the access point for the future home built on lot 1 instead of extending Heinrich Drive past the existing cul de sac. Adam Trzebiatowski and I have discussed this matter and do not see any concerns with this request. Currently, lot 1 has an existing driveway and existing structure on the property and the future plan is to use this existing driveway to serve a structure on the property. The property is not going to be used for a different purpose than it is being used today. A turn around/cul de sac already exists for the general public to turn around. Recommendation for Action by the Committee: Approve Mr. Heinrich’s request to keep the gravel driveway as access to lot 1 and do not extend Heinrich Drive past the existing cul de sac. The City of Muskego Conditionally Approves the Harvest Court plans, requiring all remaining comments noted by the City of Muskego be addressed for final approval. The Public Improvements for the Harvest Court Project include proposed asphalt roadway, ditches, driveway culverts, and roadway cross-culverts. Recommendation for Action by the Committee: Approve the plans for Harvest Court, contingent upon all City of Muskego staff comments being addressed. The topic of this meeting was the sanitary sewer connection fee that they received in the mail once their development hooked up to the sanitary sewer. This fee is the Reserve Capacity Assessment (RCA), which is the assessment to offset costs for connection to the Metropolitan Milwaukee Sewer District (MMSD). During the meeting, Jay and Sherry said the City of Muskego never informed them about any impact fees. City staff told them this was not an impact fee but a sanitary sewer fee. City staff provided them a copy of the commercial permit application general requirements (attached) that is provided to any developer who stops in. On top of page 2 it indicates to the developer to call the Utility Department for sewer and water fees. Jay and Sherry produced a copy of this document during the meeting from their file of documents as well. Scott Kloskowski confirmed that no call was ever made to the City of Muskego Utility Company inquiring about sanitary sewer fees. This fee can be paid in full or on a 5-year payment plan plus an 8% interest per annum. Jay and Sherry asked what can be done about this fee. City Staff informed them that they can go in front of the Public Works and can challenge the amount of the fee based on the type of business they are running. The owners of Pinnacle Peak Development are here to discuss this fee. Recommendation for Action by the Committee: Based on the City of Muskego municipal code all personal and commercial buildings within MMSD area are required to pay this sewer fees/RCA which was established in 1984. Pinnacle Peak Development is being treated exactly and consistently as every other business in the City of Muskego. Currently, Bellview Drive does not connect with Bay Lane Drive however there is not an existing cul de sac at the end of Bellview Drive. The right of the way exists for this connection and was always planned to be connected. This is the most cost effective time to make this connection with the reconstruction of Bay Lane Drive. Since there is not a cul de sac at the end of Bellview Drive, it makes it very difficult for emergency vehicles, garbage trucks, snowplowing or utility work to operate in this area. Large trucks need to either back up or turn around by impeding on a private driveway. Furthermore, Bay Lane Drive tends to get congested during drop off and pick off at Bay Lane School and an additional access point would be beneficial for emergency vehicles traveling along Bay Lane Drive. The City of Muskego’s policy is to encourage connectivity with every development through the City. This current design would not be acceptable to new development. Attached is the plat for the subdivision indicating a future connection from Bellview Drive (South Hillview Drive) to a future road. The plat indicates no right of way set aside for a cul de sac bulb or a tee turn around. Recommendation for Action by the Committee: It is the recommendation of City of Muskego Staff to connect Bellview Drive to Bay Lane Drive during the Bay Lane Drive Reconstruction Project per the reasons provided in this memo.
