RESOLUTION #073-2017
APPROVAL OF TEMPORARY LIMITED
WETLAND RESTORATION EASEMENT
WHEREAS, The City of Muskego has been awarded funding for wetland restoration and
desires a temporary limited easement for the purpose of a Wetland Basin Restoration
Project on the Big Muskego Lake Wildlife Area, which is owned by the Wisconsin
Department of Natural Resources (DNR); and
WHEREAS, The DNR will convey a non-exclusive temporary limited easement for a
period of ten (10) years for construction activities associated with the wetland
restoration project; and
WHEREAS, The Finance Committee has reviewed the Easement and recommends
approval to the Common Council.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby approve
the attached Temporary Limited Wetland Restoration Easement.
BE IT FURTHER RESOLVED That the Mayor is authorized to sign the Easement and
the City Attorney is authorized to make substantive changes to the Easement as may
be necessary in order to preserve the general intent thereof.

Background Information:
4Front Engineered Solutions is adding onto their existing building located off Gemini
Court and Racine Avenue. As part of their proposal they are requesting to be able to
vacate and remove a portion of the cul-de-sac bulb and to re-dedicate a new portion of
right-of-way and construct a new cul-de-sac in its place. In the end there still be a full
cul-de-sac meeting City standards.
The Public Works Committee and Plan Commission approved this vacation request
earlier in 2017 and it is now up to the Council to hold the supporting meeting processes
before the road vacation is official. An attached drawing showing the road vacation and
new dedication is attached for Council convenience.
Staff recommends approval as we move thru this process.

Subject: Reduction of Letter of Credit for Edgewater Heights Phase II Subdivision
Date: September 6, 2017
Edgewater Heights LLC entered into a Development Agreement with the City to
construct certain improvements in and for Edgewater Heights Phase II Subdivision.
These improvements include, but are not limited to, sanitary sewer, water main,
storm sewer, roadway construction and grading. The majority of the grading work
has been completed for Phase II and the Developer is now asking for a reduction to
the Letter of Credit.
I have reviewed the request and I am recommending a partial reduction to the Letter
of Credit with enough remaining balance to accomplish the remaining items. I have
estimated that with all items outstanding, the Letter of Credit can be reduced to
$920,888.61. Attached please find a worksheet detailing the Letter of Credit
reduction information for this request.
Recommendation for Action by Committee:
Recommend that the Edgewater Heights Phase II Subdivision Letter of Credit be
reduced to $920,888.61.

WHEREAS, The Conservation Coordinator reviewed the bids, under the supervision of
the Director of Public Works and Development, and recommends that the base bid in
the amount of $49,920.00 submitted by Schaefer Snowplowing and Grading be
accepted; and
WHEREAS, The Finance Committee has reviewed the bids and concurs with the
recommendation.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby accept the
bid submitted by Schaefer Snowplowing and Grading in the amount of $49,920.00 for
the Wetland Restoration Project.
BE IT FURTHER RESOLVED That the Mayor and Clerk-Treasurer are authorized to
sign the contract in the name of the City and the City Attorney is authorized to make
substantive changes to the contract as may be necessary in order to preserve the
general intent thereof.

RESOLUTION TO APPROVE THE
ESTABLISHMENT OF THE LAKE DENOON LAKE DISTRICT
WHEREAS, Landowners residing on Lake Denoon have petitioned the Board of
Supervisors of Waukesha County to establish a Public Inlan d Protection and
Rehabilitation District pursuant to Chapter 33 of the Wisconsin State Statutes ; and
WHEREAS, A Public Hearing regarding the formation of the Lake District was held on
August 31, 2017 at Muskego City Hall; and
WHEREAS, The District, if established by Order of the Waukesha County Board
herein stated, will be known as the Lake Denoon Lake District; and
WHEREAS, The purpose of the District will be to promote public health, comfort,
convenience, necessity and public welfare; and
WHEREAS, The boundaries of the proposed District include land that is exclusively
owned by the City of Muskego; and
WHEREAS, The City does not want to have any of its owned land included in the
District; however, the City does not object to any other lands located in the City of
Muskego and contained within the proposed boundaries from forming a Lake District;
and
WHEREAS, The City has been advised by the Waukesha County Corporation
Counsel that per State Statute all lands contained within the proposed District a nd
located within the City of Muskego must be approved by Resolution of the governing
body.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego approves the formation of the Lake Denoon Lake District subject to the City
owned land being excluded from the District.

Review and Recommendation Regarding Operator Application for Brooke Berthelsen
City Attorney Warchol reviewed Ms. Berthelsen’s record with the Committee. T he Finance
Committee discussed the seriousness and responsibility regarding serving and consuming
alcohol with the applicant. Alderman Kubacki moved to recommend approval of the
license with a six-month review until June, 2019 expiration. Alderman Wolfe seconded;
motion carried.
Recommend Approval of Operator Licenses
Alderman Wolfe made a motion to recommend approval of an Operator License for
Rebecca Albert, Justin Bhatti, Alicia Bourdo, Adam Cervantes, David Fischbach, Jenna
Gleason, William Rupp and Kevin Webster. Alderman Kubacki seconded; motion carried.
NEW BUSINESS
Review and Recommendation Regarding Pop-Up Beer Garden Agreement between the City of
Muskego and Raised Grain Brewing Company
Finance Committee Minutes 2
August 22, 2017
Director Kroeger stated there is a proposed agreement with Raised Grain Brewing Co. to
provide a pop-up beer garden at Veteran’s Park on Friday, September 29, 2017 and Saturday,
September 30, 2017. Mr. Nick Reistad was present on behalf of Raised Grain. Mr. Kroeger
stated beer gardens have become a successful way to provide family-oriented gatherings while
offering a new revenue source for parks. This beer garden would be a trial run for the City.
Alderman Kubacki made a motion to recommend approval. Alderman Wolfe seconded;
motion carried.
Approval of Light Fixture Replacement at Champions Village Subdivision
Director Kroeger stated light fixtures at the entrances to Champions Village need to be replaced.
There are two HPS fixtures at each entrance and the recommendation is to replace them with
one LED fixture. The cost is $4,640.25. Alderman Kapusta made a motion to approve.
Alderman Kubacki seconded; motion carried.
Approval of Repainting Pickleball Courts at Lions Park
Mr. Kroeger stated two quotes were received with the lowest from Armstrong Paving in the
amount of $4,897.00. Alderman Wolfe made a motion to approve. Alderman Kapusta
seconded; motion carried.

Alderman Wolfe made a motion to recommend approval of Utility Vouchers in the amount
of $42,844.29. Alderman Kubacki seconded; motion carried.

Director Kroeger stated final plans were completed. Will be going out to bid December 12,
2017, with plans to start construction in May 2018.
2017 Road Program
Director Kroeger stated the annual Road Program was almost completed.
Middle School Water Main Project (Hi View Drive)
Director Kroeger explained the water main project has been a combination of the water main
installation and the secondary access to the school. The school district will be closing on a
house September 22, 2017, to gain the secondary access needed. Public hearings will be held
in September and October to discuss residents hooking up to City water. He continued that
bids will go out November 1st, 2017. The City plans to work through winter and complete the
job in May along with required landscaping.

Status of Sewer Connection
Director Kroeger referred to the Memo regarding the three Boxhorn properties that are
required to connect to the sanitary sewer. Director Kroeger asked that Wayne Hendrickson
come forward and state his case to the Public Works Committee. Mr. Hendrickson is selling
his house and the buyers plan a remodel that may change the connection hookup location. He
is requesting a four (4) month extension for the new owners to handle the connection.
Alderman Borgman made a motion to approve the four (4) month extension for the
Hendrickson residence, Alderman Engelhardt seconded.
Motion Passed 3 in favor.
Little Muskego Lake Drawdown
Director Kroeger began by giving a summary of the whole drawdown project, including the nine
(9) conditions from the DNR, how the drawdown is to be monitored and the dates this will take
place.
Alderman Madden requested Heidi Bunk from the DNR to come forward and answer questions
from the Public Works Committee before opening the floor to the public. Questions addressed
included farm land and water levels in low areas downstream, snow cover preventing a deep
freeze, boat traffic bringing the invasive species back, being a "guinea pig” lake, will this
possibly help prevent other invasive species, using chemical treatments instead and permits
needed by the DNR for homeowners to do shoreline work.
Director Kroeger reiterated again the strain on City resources to complete this drawdown in the
time permitted. He reminded everyone in attendance this will delay other projects as well.
Tom Reck of the Little Muskego Lake District (LMLD) explained the time spent on researching
the invasive species and truly believes now is the time to complete the drawdown. He feels if
the City waits until next summer it will be too late and further into the deeper water, where it is
much harder to fight. He stated the LMLD is willing to help the City with temperature
monitoring, along with removal of the piers and buoys. Mr. Reck also stated after the City
approval the LMLD is ready with email blasts, a Facebook page, flyers for mailboxes and piers
to get the word out as quickly as possible regarding the removal of boats, docks and piers.
Mark and Jim both representing the Bay Breeze Condominium Association stated they were in
favor of the drawdown and were already in the process of coordinating the removal of all
boats, docks, and piers.
Deb Klismet of Kingston Drive was greatly concerned over the possible financial burden the
City may force onto the LMLD after the drawdown is complete. She feels expenses should be
shared with the City since others use the Lake, not just the homeowners on the Lake. She
suggested the possibility of grant money from the DNR, since Little Muskego is being treated
as a "guinea pig".
Steve Klingler of Muskego Drive expressed his complete lack of knowledge of the drawdown,
and stated many neighbors were just beginning to hear about it now, the day before the vote
by Common Council. He felt a great lack of communication from LMLD. Mr. Klingler also
stated many neighbors thought the DNR was paying for the drawdown. He asked Director
Kroeger about overtime charges to LMLD. Director Kroeger stated the City would remain at 40
hours per week, unless unforeseen emergencies would arise outside of business hours.
Mr. Klingler's final concerns were about the shallow wells and the impact on the fish
population.
Jim from the Little Muskego Lake Association, stated he felt the information regarding the
drawdown has been out to the public for some time and expressed his yes vote in going
forward with the drawdown on behalf of the LMLA.
Steve Olson, the Treasurer for LMLD, stated $100,000 has been spent over the last two (2)
years to research the invasive species. He believes the City and the LMLD should work
together to proceed with the drawdown.
Suzi Link of Lannon Drive expressed financial concerns that the City will stick the LMLD with
all the expenses when in fact the City owns and maintains the dam. She believes costs should
be assumed by both parties. Her other main concern was the need to draw the Lake down a
full seven (7) feet. Ms. Link stated all the invasive species are in shallow water and felt we
should consider a five (5) foot drawdown. She fears that drawing the Lake down too far will
disrupt the ecology of the Lake and possibly open us up to new invasive species.
The Public Works Committee and Heidi from the DNR, continued to talk briefly about special
fishing regulations during the drawdown.
Alderman Borgman made a motion to defer the Little Muskego Lake Drawdown to the
Common Council, Alderman Engelhardt seconded.
Motion Passed 3 in favor.
