CALL TO ORDER
Mayor Chiaverotti called the meeting to order at 6:09 p.m.
ROLL CALL
Present: Aldermen Wolfe, Hammel, Borgman, Engelhardt, Kubacki and Madden. Alderman
Kapusta arrived at 6:29 p.m. Also present: City Attorney Warchol and Deputy Clerk Blenski.
APPROVAL OF MINUTES - June 27, 2017
Alderman Wolfe made a motion to approve. Alderman Kubacki seconded; motion
carried.
NEW BUSINESS
Discuss Rezoning Sunset
Attorney Warchol stated he could not find other municipalities that have this provision in place.
While he does not believe it is illegal, he made the following points:
If a property is rezoned, a potential developer typically incurs expenses to initiate
development of the property. This gives him a vested interest in the property as it is
zoned. If the zoning reverts back to what it was originally, the City could face a claim
being filed.
Rezoning is what is best for the land, not a specific individual.
The City does not want to create situations that would detract from future developments
coming to Muskego.
Market conditions change which may cause a developer to postpone development for
quite some time. The School District is a good example. The land for the new school
that is under construction was purchased back in 2008.
Equity and fairness must be taken into consideration.
Developments can take a substantial amount of time to complete.
Alderman Borgman noted that extensions can be granted when delays occur. However, the
City has been promised developments with specific details that never materialized.
Mayor Chiaverotti stated there are controls in place to ensure that if an approved development
does not happen within the granted time period, or if something different is proposed, the
developer has to begin the approval process again. Alderman Engelhardt agreed. He noted
that zoning never guarantees what will be developed. Building permits and Plan Commission
approvals add another level of control. Alderman Kubacki stated financing may be an issue for
a development if the zoning can change during the course of the project.
Aldermen Wolfe and Hammel expressed concern about the rights of property owners.
Following discussion, the consensus was no change.
Discuss Possible Goat Regulations
Mayor Chiaverotti stated that Graef prepared a memo regarding the regulations for keeping
goats on agricultural and residential properties.
Goats are currently allowed with a Conditional Use Grant (CUG) in the A-1 Zoning District.
Following discussion, Alderman Kubacki proposed the following:
Eliminate the CUG requirement for the A-1 Zoning District with inclusion of the
minimum requirements outlined in the Graef memo.
Minimum lot size must be 120,000 square feet in any zoning district.
Require the CUG with inclusion of the minimum requirements in all residential zoning
districts.
The Mayor will take the proposal back to staff.
Discuss Agricultural Buildings for Commercial Gatherings
Mayor Chiaverotti stated this will be a general discussion, and not about any specific property.
She noted that Graef submitted a memo, which reviewed event/wedding venues as uses within
Agricultural Zoning Districts.
Following discussion, the consensus was that a Conditional Use Grant should be required.
Staff will come back with a revised recommendation.
Discuss Festival Parade Participation
No changes were recommended.
Facilities Update and New City Hall Meeting Rooms
Mayor Chiaverotti distributed Materials for Posting Policy and Public Display and Exhibit Space
Policy. These policies are currently used at the Muskego Public Library. She believes they
are very well written and should be implemented for the new City Hall facility. There were no
objections.

Alderman Engelhardt made a motion to adjourn at 7:03 p.m. Alderman Hammel
seconded; motion carried.
