Alderman Kevin Kubacki called the meeting to order at 5:00PM.

RE: Land Division of S76 W12677 McShane Drive – Water Improvement Requirements
Dear Public Works Committee Members,
I am writing to request a modified water improvement scope for a proposed land division at S76
W12677 McShane Drive. Because there is an existing quality tree line along the edge of the
roadway that would have to be completely removed in order to install a full water main along
Nursery Court I am requesting that an alternative way of providing water to the newly created
lots be considered. The existing residents on the west side of Nursery Court most certainly enjoy
the nice screening that these trees provide and would not be pleased if they had to be removed.
The pictures below show the existing trees looking north from McShane and looking south from
the cul-de-sac. I believe development should occur in a fashion that allows the least amount of
disruption to the existing environment and neighborhoods. This is in accordance with the City’s
strategic goals of preserving the City’s existing natural character when planning developments
whenever possible.
I understand that the Committee would like the newly created lots to be served by public water
so I am offering the following solution that would both serve all of the new lots with water and
preserve the natural character of this area. The attached concept land division shows the most
feasible land division option. I am proposing that instead of destroying the trees along Nursery
Court, individual laterals be allowed to serve all four newly created lots from McShane Drive
through easements dedicated to the lots that they serve. Each lateral would be publicly
maintained within the right-of-way as is standard with all laterals in the City. Once the laterals
reach private property easements they would be owned and maintained by the property owner.
Long water laterals have been used throughout the City without issue in the past. I would install

all laterals in the easements up to the lot line for each property utilizing a trenchless technology
available for installing HDPE laterals that would prevent any tree loss. This would be done in
advance of selling the land so that water laterals would be readily available for each owner to
connect to when building their homes.
I look forward to discussing this issue with the Committee and am available to answer any
questions you or City staff may have in advance. I believe this is the most feasible approach that
balances the needs of the land owners and the desires of the City to serve newly created lots with
public water.

Subject: Review Request for Review of Water Main to be Required as Part of a
Potential Land Division of MSKC2208-997-001
Date: April 12, 2017
The attached was received from David Simpson in reference to a potential land
division on the east side of Nursery Court. Mr. Simpson is asking that the
Committee not require municipal water main to be installed on Nursery Court as
part of a potential land division. However, Mr. Simpson is proposing four
individual laterals to serve four newly created lots to offer municipal water. The
four laterals would be constructed in advance of selling the lots and would be
installed in an easement up to the individual lot line. Mr. Simpson makes reference
to the loss of a tree line for the water main installation, costs, and that the original
developer for Nursery Subdivision was not required to install water main. Water
main is available along McShane Drive. The same request was made at the August
11, 2016 Public Works Committee meeting by the Neumann companies. Staff
recommended and the motion was passed that public improvements be required of a
potential land division of MSKC2208-997-001.
Recommendation for Action by Committee:
Require a municipal water main extension in Nursery Court for any land division of
MSKC2208-997-001 as the Public Works Committee passed on August 11, 2016 for
the same parcel.
