Respectfully submitted, Kellie McMullen, Transcribing Secretary Page 1 of 2 CITY OF MUSKEGO Staff Memo to Parks and Conservation Committee To: Parks and Conservation Committee From: Tammy Dunn, Recreation Manager Subject: Muskego Community Festival Park Facility Request Date: March 27, 2017 Attached is a request from the Muskego Community Festival group for their rental of Veterans Memorial Park from August 21-August 29, 2017. The request is for 7:00 a.m. to 8:00 p.m., however it has been indicated that is the time they will arrive on 8/22 to the time the leave on 8/30. Park hours are asking to be extended to 11:30PM. Also, attached is an email outlining information on parking plans with the anticipated construction at city hall. Recommendation for Action by Committee: Recommend approval of the event with the following conditions: 1. Park Rental fee is waived for the dates of August 21-August 29. 2. Park hours are approved to extend to 11:30 p.m. on the nights of the festival: August 24, 25, 26 and 27. 3. The Festival Committee will be utilizing an outside contractor to provide any grounds maintenance needed prior to and at the conclusion of the event. 4. Renter would secure event insurance listing City of Muskego as an additional insured with the dates of the event being from the day carnival vendors arrive until August 29 when all festival items are gone. 5. Renter will have a dumpster placed alongside the parking lot on Pioneer Drive. Said dumpster would be removed promptly by August 29 or daily park rental fees will be charge to the festival committee until the dumpster is removed. 6. Discussion will take place in July in regards to alternate parking options for the areas around city hall as construction begins. 7. Beer permits for the park as well as a liquor license will be secured no later than August 11. This is to cover the carnival vendors on city grounds up to the start of the festival (8/21-8/29). Once a copy of the selling of beer permit is received from the City, please forward on a copy to the Recreation office to be placed with your rental documents. 8. Carnival vendors who will be camping on park grounds, it is suggested that they park all recreational vehicles and those vehicles used to tow the carnival rides on the asphalt areas of Old Town Hall. It is recommended that all heavy equipment is kept off the wet area off the tree lined area bordering the park. Page 2 of 2 9. The city will have the restrooms cleaned on August 20 after our rental and then locked to the public. Restrooms will not be opened for carnival vendors. If park users wish to use restrooms during the week leading up to the festival, they will be able to access city hall during normal business hours, or if a festival committee member is available, they can open the restroom for the resident. Festival staff will make sure the restrooms are kept clean daily (including making sure all toilets are flushed, paper products & hand soap are available and that the restrooms are clean.) 10. Carnival vendors may not run hoses or power cords from Veterans Park Shelter for hook-up for the personal water or electric. It is understood there is a need to run water from the shelter to the shower facility for the carnival vendors. This hose will be secured and taped down as it crosses over the paths to reduce the risk of injury to park users. 11. Carnival vendors will be instructed prior to their arrival that there are no dogs allowed in city parks and that includes the time they are on site overnight. Page 1 of 1 CITY OF MUSKEGO Staff Memo to Parks and Conservation Committee To: Parks and Conservation Committee From: Tammy Dunn, Recreation Manager Subject: Policy Change for Beer Permit Date: March 27, 2017 Due to the amount of staff time both in office, out in the field and through the Police Department to track beer permits and the increase in the number of permits issued yearly, we would like to now charge a $5.00 fee for the permit for Muskego residents. Currently, only non-residents of Muskego pay a fee of $10.00. The money from the permits goes into the Recreation Department budget to help offset the Park Ranger and Park Attendants at Idle Isle staff salaries. Attached is the current Beer Permit Policy. Muskego Parks and Recreation Operating Policies and Procedures Beer Permit City ordinance 26.02 (d) stipulates that the consumption of beer will be allowed in any City of Muskego park by permit only. A permit must be obtained at the Parks and Recreation Department office during regular office hours at least one complete week prior to the date requested for usage. Permit applications must be filed in person, as a valid operator’s license, Wisconsin I.D., or birth certificate must verify age. Fee for the permit is $10 for a non-resident and no fee to residents of Muskego. Rationale: To establish a consistent policy for consumption of beer in parks system. Application must be made to the Parks and Recreation Department at least one week prior to the requested date, five working days. Groups or individuals wishing to sell beer may do so only with the required permits, including proper City Common Council approval. No minor shall bring or drink alcoholic beverages in any city park at any time. Any individual and/or organization receiving a permit accepts the responsibility for cleaning the area used and leaving in an orderly manner. All rules and regulations under City Ordinance Chapter 26 shall be in effect. *Fees: Resident/No Charge, Non-resident/$10.00. It is the applicant’s responsibility to have the signed permit at the park facility the day it is in effect. Adopted by the Parks and Recreation Board 1/21/85. Because of recent Court decisions in Wisconsin dealing with the potential liability your organization faces when you serve beer, the following checklist is furnished to you in hopes that it will assist you in protecting your group from liability exposure. PLEASE READ AND FOLLOW THESE RECOMMENDATIONS: 1. Seek advice from your organization’s attorney on the liability involved in dispensing beer. 2. Incorporate your organization as a non-profit corporation under Chapter 181, Wis. Stats. to isolate your members from liability. 3. Obtain the best liability insurance your organization can afford. Be sure it covers liquor- related liability. 4. Make sure all persons who are consuming beer are very familiar with Wisconsin liquor laws. Identify youngsters and persons who should not be consuming fermented malt beverages under the liquor laws. 5. Check with your own homeowners insurance company or your liability insurer as to whether you are personally covered for such a happening. 6. P D F -X C h a n g e View er ww w .d o c u -t r a c k .c o m 1 AGREEMENT FOR MAINTENANCE AND IMPROVEMENTS TO CITY OWNED FIELDS This Agreement is made and entered into on the day set forth herein, by and between the City of Muskego, (“City”), The Muskego Athletic Association, (“M.A.A.”), and the Muskego Warriors Baseball Program, (“Warriors”), collectively the “Parties”. WHEREAS, the M.A.A. and the Warriors use fields owned by the City on a yearly basis for Youth Baseball Leagues; and WHEREAS, the Parties wish to enter into an Agreement for maintenance of said fields as well as potential capital improvements made to the fields to promote a safe and productive environment for all end users. THEREFORE, based on the above, the Parties hereby agree to the following: 1. MAINTENANCE OF FIELDS A. Routine maintenance includes, but is not limited to the following: pre-season/spring tune up, weed control to be applied twice per season, top dressing, replacement of base pegs and home plates, mid-season tune-up and grass edging. B. Warriors agree to pay for routine maintenance of the field at Kurth Park. C. M.A.A. agrees to pay for routine maintenance at Park Arthur diamond numbers 1, 2, 3, and 4, Horn Park, Bluhm Park diamond numbers, 1, 2, 3, and 4 and Denoon Park. D. City to be responsible for all routine maintenance at Jensen Park. E. City to be responsible for mowing of all fields covered by this Agreement as well as all electric and water use charges for the fields including the shelters and restroom facilities. F. Routine maintenance scheduled to be performed to any field covered by this Agreement will be provided in writing by the City to the M.A.A. and Warriors by January 1st for the upcoming year/season. M.A.A. and Warriors must then notify the City by January 31st of the same year of their intention not to pay for a specific maintenance item which in turn will not be completed. Failure to provide Notice as stated herein shall be deemed as acceptance of the routine maintenance with the respective Party responsible thereon. G. All routine maintenance to all fields covered by this Agreement will be performed by a vendor chosen by the City and paid for up front by the City. The M.A.A. and the Warriors will then be invoiced in July upon completion of the season for their allocation of the routine maintenance performed for that season. The M.A.A. and the Warriors shall pay their respective invoices to the City no later than August 31st of the calendar year in which the payment was due. The M.A.A. or the Warriors will not be granted access to the fields for a subsequent calendar season until all invoices have been paid for the prior calendar year. In no event shall routine maintenance be 2 performed on any field by a vendor not retained and authorized by the City. 2. CAPITAL IMPROVEMENTS A. Capital improvements allocated for 2017 1. Park Arthur diamond numbers 1, 2, and 3 will be improved by adding 22 tons of SURE-HOP ball mix, 22 tons of SELECT ball mix, laser grade infield and compact and 3 tons of TURFACE (brown) as top dressing. The price per field for these improvements is $4,750.00 for a total project cost of $14,250.00 to be split equally between the M.A.A. and the City for a total of $7,125.00 each. The M.A.A. shall pay its share of the costs to the City on or before April 30, 2017. The M.A.A. will not be granted access to these fields until its share of the project costs are paid in full to the City. 2. Park Arthur diamond number 4 will be improved by re-edging and adding more material to the warning track. The cost of this project is $2,200.00 of which one third will be paid by each party for a total amount of $733.33 each. The M.A.A. and the Warriors shall make its respective payments to the City on or before April 30, 2017. The M.A.A. or the Warriors will not be granted access to Park Arthur diamond number 4 until its respective amounts for project costs are paid in full to the City. B. Capital Improvements beyond 2017 1. In the event that the M.A.A. or the Warriors wish to make a capital improvement to a field covered by this Agreement and said improvement is solely for the benefit of a respective Party, the Organization requesting the improvement shall be solely responsible for the cost of said improvement. Any and all capital improvements contemplated herein shall be authorized by the City. Capital improvements must be requested by the specific Organization to the City by May 31st of the preceding year to meet City budgeting timelines. If approved, the City will then bid out the work and in its sole discretion, select a vendor to complete the work. Once the project is complete to the satisfaction of the City, the City will pay the vendor and in turn be reimbursed from the Organization that requested the capital improvement. Said reimbursement shall be paid by the Organization to the City no later than thirty (30) days from the date of the invoice. Failure to make timely payment may result in a denial of access to the field by the City until the invoice is paid in full. The M.A.A. and Warriors acknowledge and understand that change orders are often made to capital improvement projects that may increase the cost of the overall improvement and agree to be responsible for the total cost of the project including all change orders. 3 3. TERM This Agreement shall terminate on December 31, 2017 and may be renewed on an annual basis thereafter upon written agreement of the Parties. 4. APPLICABLE LAW This Agreement shall be governed by the laws of the State of Wisconsin and venue for any action concerning this Agreement shall be in Waukesha County, Wisconsin. 5. DISPUTE RESOLUTION Should disputes arise between the Parties during the course of this Agreement, the Parties shall make a good faith attempt to resolve disputes through dialogue and negotiation. If such efforts fail to resolve the differences, prior to the commencement of legal action, the Parties will attempt to resolve the issues through mediation conducted in Waukesha County, State of Wisconsin, by a Wisconsin mediator chosen by Agreement of the Parties. The Parties shall share equally in all costs associated with mediation. 6. ENTIRE AGREEMENT This Agreement shall constitute the entire Agreement between the Parties and previous communications or agreements pertaining to the subject matter of this Agreement are hereby superseded. Any revisions may be made only by a written amendment to this Agreement, signed by all Parties prior to the ending date of this Agreement. 7. ACKNOWLEDGEMENT OF AGREEMENT The Parties have read this Agreement and were given the opportunity, prior to signing, to review the Agreement with an attorney. If counsel has not been retained, the Parties acknowledge the opportunity to discuss and negotiate the terms of this Agreement with the Muskego City Attorney. 8. DEFAULT Should any Party fail to carry out the terms of this Agreement, the aggrieved Party shall be entitled to exercise any and all available rights and remedies at law or in equity. 9. This is something the board/committee has discussed in the past. The Storm will be paying for all of the equipment, installation and surrounding surface materials. Standards are 10-12 feet between each flag pole, so this will be a substantial footprint. Attached are the poles types/prices the Storm Board has approved as well as some of their budget numbers. There is also a map of the suggested areas of placement. Based on an agreement we now have with The MAA/Storm and Warriors, for maintenance or improvements within the parks/ballfields, the project would be overseen and paid for by the City with the Storm providing the funds to the City before the project starts. Page 1 of 1 CITY OF MUSKEGO Staff Report to Parks and Recreation Board To: Parks and Conservation Committee From: Tammy Dunn, Recreation Manager Subject: Idle Isle Parking Fee Change Date: March 27, 2017 With the installation of two parking pay stations at Idle Isle and the inability to find a machine that can take payments based on residency a discussion needs to be had on the current fee structure of $1.00 for Muskego residents and $4.00 for non-Muskego residents and how to find a fee structure that is appropriate for each group to pay the same fee. Currently Waukesha County charges $4.00 for a daily parking fee at any of their parks. As there were no changes to the agreement and no violations from 2016, the agreements were already approved by Common Council. Secondly, please find attached the Water Bugs Ski Team practice and show dates document. The Water Bugs are requesting the same number of practices and shows as 2016. 1 Memorandum To: Parks and Conservation Committee From: Mayor Kathy Chiaverotti Date: 3/30/2017 This memo is to update the Committee on two matters as noted below. 1. At the March 28th Council meeting, the Council approved the creation of the Public Works and Development Department combining the functions of the existing Public Works and Community Development. This measure is to provide more efficiency, order, and transparency to better meet the City’s current and future needs. Also approved was the job description for the Public Works and Development Director. The new position will be posted commencing the search to fill the position. Parks maintenance continues as is through Public Works with engineering services through our contracted service with Graef USA. Parks Planning will be within the overall department as it currently stands. The new Director will determine which employee will handle related tasks within the department. With the City now fulfilling a park in the southeastern section of the City, Sandhill Park, parks planning will not be as critical in the short term. 2. This is just a reminder that when the Parks Board and Conservation Committee were merged two years ago it increased from 5 members to 7 members. City Ordinance requires it to return to 5 members commencing May 1st, 2017. Your continued service is greatly appreciated in that it aids the City in offering quality, safe, and affordable programs and facilities for recreation activities. Memo To: Parks and Conservation Committee From: Tom Zagar, CC: Tammy Dunn, Adam Trzebiatowski Date: March 29, 2017 Re: City Forester/Conservation Coordinator Report Below is an update of projects related to Lakes, Forestry, and Conservation:  .A contractor has been selected to plant 88 trees within 9 parks this spring and 12 replacement trees on Janesville Road. Because the quote for the project was reasonably low and a grant had also been acquired there were funds remaining to move forward with the project below…  The Muskego Gridiron Club has generously offered to do a community project and will help plant trees at the new Sand Hill Park. The City Forester developed a plan and ordered 27 wholesale trees. This project will be held April 26 and qualify as an Arbor Day event for Tree City USA. In this regard, Muskego was recently designated as a “Tree City” for the eighteenth consecutive year!  Restoration plans at Holz Preserve are moving forward. This past winter approximately 15 acres were dormant seeded with a diversity of native wildflowers and grasses. A contractor will be excavating some shallow “scrape” ponds later this year to restore wetland areas on the site. Some native trees and shrubs have been ordered and will be planted with volunteer help from the High School science club in spring. Muskego Lakes Conservancy is donating $500 toward tree planting and up to $500 to acquire a sign for this conservation site.  Conservation Coordinator is working with Ducks Unlimited and Wisconsin DNR staff to implement another wetland restoration project on Big Muskego Lake State Wildlife Area lands this year. This project will utilize Muskego’s “Green Solutions” grant from the Milwaukee Metropolitan Sewerage District.  Conservation programming is being offered through the recreation program including: International Migratory Bird Day, 4 Big Muskego Lake kayak excursions, and an interpretive hike at Badertscher Preserve. Such items don’t require committee action but can certainly be discussed during the Miscellaneous Business portion of the meeting. 1. We are continuing to use the new eCity software for our recreation program registration and ball field scheduling and have now added their reservation component for park rentals. The software company has been working with us to continue to make changes/updates to their program to help it work better for our department. There are still only 2 recreation departments in the country using this software, so we are helping them to make changes and improvements to make the software work better for recreation. 2. We are now working on our Summer Program Guide. Guides are scheduled to be mailed by April 17. We have some new programs like Gardening classes, Forensic classes, Adult Pickleball Leagues and are continuing to work on showcasing all the great things about Muskego like the Big Muskego Lake Scenic Kayak Tours, Badertscher Preserve Guide Hike, Recreational Tree Climbing (with Waukesha County) and so much more. We of course will be offering our full spectrum of playgrounds, preschool camps and sports camps as well. 3. Participant numbers for 2016 have been compiled. We were down significantly in 2015 due to 2 major things, the loss of the indoor swimming lessons agreement with Franklin, and the loss of the boys and girls club basketball program. We saw increase in our preschool camps and classes, all youth sports, teen sports involvement and adult programs. Our goal for 2017 is to get back up to over 6000 participants in our programs.
