PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. PUBLIC WORKS COMMITTEE - CITY OF MUSKEGO RESOLUTION #001-2016 RESOLUTION AUTHORIZING THE RETAINING OF DF TOMASINI FOR EMERGENCY REPAIR OF CULVERT REPLACEMENT ON WOODS ROAD NEAR SANDY BEACH DRIVE WHEREAS, on or about November 2, 2016, the City became aware of a possible culvert failure on Woods Road near Sandy Beach Drive; and WHEREAS, On November 2, 2016, a Structural Engineer and Bridge Inspector, working on behalf of the City, evaluated the culvert and determined that it was unsafe for public use and recommended that the road be closed immediately; and WHEREAS, Woods Road was closed on November 2, 2016 and for public safety concerns shall remain closed until the culvert can be repaired; and WHEREAS, The Wisconsin Department of Natural Resources inspected the culvert and provided verbal approval to the City to begin work on the repair of the culvert immediately; and WHEREAS, Woods Road is a crucial route for emergency first responders as well as a highly travelled route for the general public; that the road in its current condition is unsafe for travel; that time is of the essence for repair of the Woods Road culvert. NOW, THEREFORE, BE IT RESOLVED That the Public Works Committee of the City of Muskego has determined that the current condition of the culvert on Woods Road near Sandy Beach Drive is in an emergency state of repair pursuant to Wis. Stats. 62.15(1b) such that the contract for repair need not comply with the competitive bidding process requirements as outlined in Wis. Stats. 62.15(1). BE IT FURTHER RESOLVED that the City is hereby authorized to contract with DF Tomasini for emergency repair of the culvert on Woods Road near Sandy Beach Drive. BE IT FURTHER RESOLVED that the Mayor and Clerk-Treasurer are hereby authorized to execute the contract with DF Tomasini subject to terms and conditions as approved by the City Attorney. Paulos, P.E., Director of Public Works/City Engineer Subject: Woods Road Emergency Culvert Replacement Date: November 8, 2016 Last Wednesday, I received an email from Dan Flamini about a possible culvert failure on Woods Road near Sandy Beach Drive. Kevin Wood, a structural engineer and bridge inspector from GRAEF, evaluated the culvert and determined that it was unsafe for the traveling public. At that time we recommended to the City that the road be closed immediately due to safety concerns. The road was closed and remains closed. Due to Woods Road being an important route for emergency responders, we met with the WDNR to discuss permitting requirements to expedite the approval process. We received verbal approval from Craig Webster to begin the work immediately on Friday. We are currently preparing plans for the culvert replacement on Woods Road near Sandy Beach Drive. I am in discussions with DF Tomasini as far as culvert availability, construction crew availability, and methods of construction to expedite the construction process and get Woods Road open as soon as possible. I am recommending that the City directly hire DF Tomasini to perform this emergency repair work and to forgo the public bidding process due to time being of the essence. DF Tomasini is already under contract with the City to perform emergency utility work such as water main repairs. Recommendation for Action by Committee: Recommend the City to forgo the public bidding process and directly hire DF Tomasini for the emergency culvert replacement on Woods Road as time is of the essence due to emergency response times for first responders.
