The SW District states that the construction and maintenance of roadways can be allo wable with a CUG. The proposed Preliminary Plat for the Edgewater Heights Subdivision shows the southern roadway, named Edgewater Heights Way, needing to cross a narrow wetland area on site. See the exhibit below for the area in question. DISCUSSION PC 049-2016 The petitioner has been and is continuing to work with the DNR to get all proper approvals as required through them for the wetland crossing. The resolution has the following conditions listed within it to ensure that all proper approvals and steps are taken to ensure compliance with the City’s codes:  BE IT FURTHER RESOLVED, The recording of the CUG cannot occur until the City received proof from the DNR that they are allowing said wetland crossing.  BE IT FURTHER RESOLVED, That the final plat for the subdivision cannot be recorded until the CUG has been signed and recorded. It would more specifically be located in the former Quiznos Subs location on the south side of the building. The business will offer customers the ability to walk-in to order/pick-up and also contain a pick-up window. PLAN CONSISTENCY PC 050-2016 Comprehensive Plan: The 2020 Plan depicts the property for Commercial use. The proposal is consistent with the plan. Zoning: The property is zoned PD-37 Candlewood Planned Development District. The proposal conforms to the bulk requirements of the zoning district. Conservation Plan: No acquisition or management areas are proposed in the project area. The proposal is consistent with the Plan. Street System Plan: No dedications are needed as part of the new BSO. The proposal is consistent with the plan. Adopted 208 Sanitary Sewer Service Area: Municipal sanitary sewer serves the property. The proposal is consistent with the Plan. Water Capacity Assessment District: Municipal water serves the property. The proposal is consistent with the Plan. Stormwater Management Plan: Stormwater facilities should not be required, but this will be reviewed by the Engineering Department at the time of permitting. DISCUSSION PC 050-2016 As is noted above, Little Caesars is looking to locate within the Jetz Convenience Center building. As part of locating at this site, the applicant would like to add a pick-up window along the south side of the building. To access the new pick -up window a new driveway with curbing is proposed between the main building and the car wash building. The driveway will be located just to the north of the existing electrical transformer. Given the proximity of the new driveway in relation to the transformer and other utility features, bollards are required adjacent to any structures/features near the driveway (i.e. transformer, building utilities, etc.). All bollards must be painted a color that matches the building. Also, as part of the new curbing and driveway, t wo (2) parking stalls are being removed in the front and the back of the building. This still leaves plenty of parking throughout the rest of the site. As part of the proposal it is noted that there will be no menu board or ordering speaker as part of the pick-up window area since all ordering is done at the window or ahead of time by phone. This, along with the “hot and ready” concept, is what makes this ordering process different. This is why the applicant is stating the pick-up window is different than a traditional drive-thru. The proposal states that if someone needs to wait for an order they could do so at the exit of the pick- up lane or behind the building. Staff has concerns with parking is these traffic areas and as such no “waiting” parking spots are allowed behind the building, at the exit of t he pick-up lane, or in the back driveway. This means that anyone waiting for a product must wait within the existing parking stall already established in the front of the site. At this time there are no new/altered exterior lighting proposed. Any new or altered exterior lighting will need approvals from the City and details will need to be submitted relating to the fixture specs and a photometric plan. Some signage details are included as part of the proposal to include signage on the monument sign, on the front of the building, and a canopy over the pick -up window. All signage (temporary and permanent) will require separate formal permits. PETITIONER: City of Muskego INTRODUCED: July 25, 2016 LAST AGENDA: N / A PREPARED BY: Jeff Muenkel, AICP DISCUSSION PC 051-2016 A public hearing for the adoption of the new Parks and Conservation Plan will occur on Tuesday July 26th at 7 pm before the Council. The public hearing is required since we have to amend text in the City’s Chapter 41 Comprehensive Planning Code. All the past City Park and Conservation Plans are adopted as part of the City’s Comprehensive Plan. Due to t his, we need to assert that this new Parks and Conservation Plan is also adopted as part of the City’s 2020 Comprehensive Plan per the code change. This code language change can be found in the adopting resolution attached herein tonight. The new 2017-2021 Parks and Conservation Plan will be adopted as an attachment to the Common Council ordinance as well. The new 2017-2021 Parks and Conservation Plan is a yearlong effort by City staff and the Parks and Conservation Committee. As many know, this new plan took many more steps than any previous plan. Full assessments of each park and open space were taken into account and thousands of surveys to the users and residents were inventoried. The resulting new plan has key recommendations for the overal l park and conservation system as well as individual recommendations for each park area. Staff will review of the larger details surrounding the Plan at the PC meeting. STAFF RECOMMENDATION PC 051-2016 Approval of Resolution PC 051-2016 RESOLUTION #P.C. 051-2016 RECOMMENDATION TO COMMON COUNCIL TO AMEND SECTION 41.06 OF THE MUNICIPAL CODE AND ADOPTION OF THE NEW PARK AND CONSERVATION PLAN WHEREAS, Chapter 41 regulates Comprehensive Plan element regulations within the City of Muskego, and WHEREAS, A portion of Chapter 41 needs to be amended in order to adopt the new Parks and Conservation Plan as a detailed component of the Comprehensive Plan, and WHEREAS, This adoption gives the plan the weight it needs to enforce the recommendations found within on future developments and decisions, and WHEREAS, Parks and Conservation staffs have been preparing updates to the 2017-2021 Parks and Conservation Plan, and WHEREAS, The Park Board and Conservation Commission have approved the 2017-2021 Parks and Conservation Plan, and WHEREAS, A public hearing will be heard to consider the matter on July 26, 2016.
